K. Bhaskaran, C.J. and Anjaneyulu, J.1. We have heard the learned counsel for the petitioner and also the learned Government Pleader on behalf of the respondents. 2. The submission made by the learned counsel for the petitioner is that the revision notice dated October 13, 1987, proceeds on the assumption that it is for the assessee to prove that raw material had already suffered sales tax. His submission is that the assessing authority proceeded after being satisfied that the raw material had already suffered sales tax. Inasmuch as it is only a notice, we do not think that at this stage we would be justified in interfering with the proceedings initiated by the first respondent, the Deputy Commissioner of Commercial Taxes, Charminar Division, Hyderabad. ORDERSeetaram Reddy, J.1. The 2nd defendant, the revisionist herein, seeks to revise the orders passed by the trial Court. 2. The format in brief is that the plaintiff, the 1st respondent herein, filed a suit against the petitioner and the 2nd respondent-State Bank of Hyderabad. Eight issues have been framed based on the pleadings. One of the issues viz. issue No. 6 is whether the plaint has been, instituted by a person validly representing the plaintiff. It is not in dispute that the suit was instituted in the year 1982 and issues, were framed on 7-6-1983 and the suit was posted for trial on 4-7-1983. The suit was dismissed for default on 6-8-1983. Again it was restored and posted to Sept. 20, 1983, but from then onwards it was adjourned several times and eventually to 10-7-1984. This is an appeal preferred jointly by the owner of the vehicle as also the Insurance Company questioning an award of Rs. 37,500/- made by the Court of Additional District Judge-cum-Additional Motor Accidents Claims Tribunal, Krishna. The accident occurred on 21-4-1981 at Vijayawada and the respondent who was injured suffered a fracture on his left ankle. The respondent underwent treatment at Vijayawada and also at Madras, but he was, however, left with a permanent disability as he has to limp. On account of the said disability, the respondent who was a photographer by profession, suffered detriment and claimed damages.
