K. Ramaswamy, J.1. Appellant is the owner of APW 1665, a lorry covered by insurance policy Exh. A-1, dated 27-6-1976. An accident has occurred on July 29, 1976, in which an employee of the Central Government was knocked down by the driver of the lorry whereat he died. Proceedings were initiated in C.C. No. 571 of 1976 on the file of the court of the II Addl. Judicial First Class Magistrate, Guntur, for an offence under Section 304A, Indian Penal Code. The driver was convicted for rash and negligent driving of the vehicle on 6-5-1977. Subsequently, the legal representatives of the deceased laid O.P. No. 14 of 1977 on the file of the Motor Accidents Claims Tribunal, Guntur and a decree for a sum of Rs. 30,000/- and odd was granted by judgment Exh. A-5, dated February 8, 1978. The respondent discharged the liability pursuant to the contract of insurance under Exh. A-1 and filed a suit for recovery of the amount from the appellant owner of the vehicle. ORDER1. The Petitioner, Andhra Cement Company Limited, seeks to issue a writ of certiorari to quash the proceedings dated May 6, 1982 of the Regional Provident Fund Commissioner, Hyderabad. 2. The relevant circumstances in which the impugned proceedings have been issued may be set out : The petitioner-Company, incorporated under the Indian Companies Act, established a cement factory known as 'Andhra Cement Factory' at Vijayawada in the year 1938. In the year 1978 the management established another factory styled 'Visakha Cement Work's at Visakhapatnam. The State Government allowed interest-free sales tax loans, a rebate of 25% in power tariff and other facilities as incentives to the new industry. The Commissioner of Labour also recognised it as a separate establishment. The service conditions are totally different from the service conditions of the workmen working in Andhra Cement Factory. 1. Detendants 2 and 3 are the appellants. The 1st respondent, after becoming major, the 2nd respondent being minor represented by his brother the 1st respondent, laid the suit but subsequently he was declared as major by order dt. June 29, 1977 in I.A' No. 392 of 1977. The suit was for possession of plaint A and B schedule properties and to eject the 1st defendant from plaint A Schedule property and the appellants from plaint B Schedule property consisting, of one acre. P.A. Choudary, J.1. The two petitioners, Chandramma and Veeramma, are the widows of a late Adivappa, a resident of Sadasivapet, Medak District. The late Adivappa opened a special savings bank account No. 161 with the State Bank of Hyderabad, Sadasivapet. For some reasons, which is not necessary to go into, he had closed that account and transferred the balance to an ordinary savings account No. 2471. On the same date, he had nominated his two wives as his nominees. The bank accepted the deposit of about Rs. 10,00,000 and raised on objection to the nomination of the two wives. The said Adivappa subsequently died in the month of March, 1987 : The petitioners herein who are the two nominees of Adivappa approached the State Bank of Hyderabad, Sadasivapet, for withdrawing the amount deposited by Adivappa with the bank. B.P. Jeevan Reddy, J.1. A common point arises in these three writ petitions. So they are disposed of by a common order. We shall deal with the facts in W.P. No. 3396 of 1982. 2. In this writ petition the validity of a notice dated 30th April, 1982 issued by the first respondent, Commercial Tax Officer (Intelligence) No. III, is challenged. Prior to the impugned notice, the first respondent had issued a notice dated 27th April, 1982 calling upon the petitioner to produce certain documents and supply certain information. Under the impugned notice the first respondent stated that in pursuance of the earlier notice the petitioner has furnished only some of the details asked for and that he has not furnished the remaining details. He therefore called upon the petitioner to appear before him on a particular date along with the documents specified in the notice.
