1. The first defendant is the appellant. The suit was laid for settlement of accounts of the partnership dealings between the plaintiff and the two defendants. The allegation in the plaint is that the plaintiff and the defendants constituted a partnership firm and agreed to jointly carry on the contract work in 1965 for the maintenance work to be carried on from the mile stone 17/10 to 26/4 in Guntur-Narasaraopet road, that the contract work was taken in the name of the 1st defendant, that the plaintiff invested a sum of Rupees 11,000/-. While the 2nd defendant invested Rs. 3,000/-, and that it was agreed that the 1st defendant should be in the management of the work, maintaining regular account books and keeping the same for perusal and inspection for at all times. When the plaintiff demanded the 1st defendant to settle the account of the partnership and pay the moneys due to the partners, he refused either to show that account or settle same. Amareswari, J. 1. This tax revision case arises in the following circumstances : 2. The petitioner is a dealer in rice and groundnuts. For the assessment year 1975-76 the petitioner returned a net turnover of Rs. 5,83,060 and claimed an exemption of Rs. 7,91,732. On 24th July, 1975, the business premises of the petitioner was searched by the commercial tax authorities and certain variations were found in stock position with reference to the stock registers. The Commercial Tax Officer by his order dated 5th October, 1976, determined such total variations at Rs. 36,916 and added the same to the admitted turnover. After disallowing certain exemptions the net turnover was determined at Rs. 9,59,390. Subsequently the Commercial Tax Officer initiate penalty proceedings and by his order dated 6th June, 1977, levied penalty of Rs. 9,982 i.e., at five times the tax alleged to have been suppressed. 3. Raghuvir, J. 1. This appeal relates to a choultry in Ongole town run in the name of 'Ayyanna Chetty Choultry'. It is seen, in its name the founder's name is incorporated. The two grandsons of the founder, P. Kondaiah Chetty and P. Venkata Subbarayudu, obtained a declaration from the Deputy Commissioner of Endowments on Nov. 18, 1969 holding that the premises of the building is not governed by the provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act 17 of 1966 (the Act). Thereupon, a social worker, C. V. Subrahmanya Sastry, two persons, Shaik Abdul Manaf, Manthri Seetharamaneyulu, who described themselves as poor persons, two others, P.
