Kondaiah, J.1. As the question involved in these three cases is one and the same, it is convenient to dispose of the same by a common Judgment.2. The petitioners in W. P. No. 2504 of 1973 and the appellants in W. A. Nos. 172 and 332 of 1973 are commission agents who obtained licences under the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act (hereinafter referred to as the 'Markets Act') for carrying on business in the market area of Kamareddy. These dealers mainly act as commission agents to the agriculturist-principals in selling their jaggery, pulses, etc., by open auction in the market area on payment of the prescribed percentage of commission for the services rendered by them. They at times advance monies to the agriculturists and facilitate the storage of the goods in their godowns. This writ petition is filed by the petitioner Praga Tools Ltd., challenging the award of the Labour Court in industrial Dispute No. 35 of 1969 overruling the preliminary objection raised by the petitioner, viz., that in view of the settlement arrived at between the parties in the course of the conciliation proceedings, the question of raising any industrial dispute by the workmen or referring it under Section 10(1) of the Industrial Disputes Act, does not arise.2. The petitioner is a public sector industry. There are two rival unions in this industry, one is called the Praga Tools Employees Union and the other Praga Tools Mazdoor Sabha. While the former is affiliated to the All India Trade Union Congress, the latter is affiliated to the Indian National Trade Union Congress. Ekbote, C.J.1. Adusumalli Punniah was adjusted insolvent in I. P. No. 36 of 1933 by the Sub-Court. Machilipatnam on 28-9-1934. the petitioner is the wife of A. Punniah. The Official Receiver was appointed as interim receiver. He sold the undivided one-third share of the insolvent. It was purchased by two persons. They separately filed two suits O. S No. 38 and 39 of 1956 for partition and possession of the one-third share of the insolvent in the properties which they purchased.2. Both the suits were tried together and preliminary decrees were passed. Defendants 4 and 5 in the said suits filed appeals in the High Court, A. S. Nos. 317 and 318 of 1961.3. Earlier the appellants in the above said appeals had filed O. S. No. 45 of 1964 for setting aside the alienations of certain properties of the ground that these alienations were not supported by consideration and were not binding on them.
