Chandra Reddy, C.J. (1) A reference was made under Sec. 27 of the Workmen's Compensation Act by the Additional commissioner, Workmen's Compensation Andhra Pradesh under the following circumstances. (2) An application was filed before him under Sec. 19 of the Act by the widow of one Mastana, an employee of the respondent claiming a sum of Rs. 1,200/ by way of compensation. Mastan, in the service of the respondent. His duties consisted in buying rice and other articles for the respondent and exporting them by boats. On 20-10-1953 he purchased rice on behalf of the respondent at vijiyavada loaded it in the boat and was travelling in the boat. Unfortunately the boat capsized while in the middle of the river with the result that eight peresons including the deceased died. Manohar Pershad, J. 1. This appeal on behalf of the decree-holder arises out of the execution proceeding started by him. The decree-holder filed a suit against the respondent-judgment debtor for a sum of Rs. 3319-11-0 on 18th Mehar 1350 Fasli. The respondent, through his written statement dated 22nd Aban 1351 Fasli admitted the claim of the decree-holder to the extent of Rs. 2031-0-2 only and requested the Court to give him six months' time to pay that amount. The respondent did not pay that amount. Subsequently, on 15th Dai, 1353 F. when the case came up for hearing before the trial Court, the appellant's lawyer and the appellant himself, who was present in Court, requested the Court to grant a decree against the respondent to the extent of the amount already admitted by him under Order XII, Rule 6 (1), C. Seshachalapati, J.(1) This is an appeal against the decision of the learned Subordinate Judge Eluru, dismissing O. S. No.125of 1955.(2) On 22nd of August 1954, one Ryali Ramamma, the widow of Ryali Sashagiri Rao, died, in the house of her sister, Chandramathi the 1st defendant in the suit, at Eluru. On 21-9-1954 the appellant, Ryali Kameswara Rao, the brother of late Seshariri Rao launched an action claiming the lands houses, personal effects, outstanding and deposits that Ramamma died possessed of and described in Schedule 'A' to 'E' and for a declaration that the will alleged to have been executed by her on 21-8-1954 is neither genuine, nor valid, that she died intestate and for other ancillary relief's.(3) Originally 19 defendants were impleaded in the suit. ORDER(1) The defendants in small Cause suit No. 157 of 1957 are the petitioners before this Court. The respondent filed a suit for the recovery of a sum of Rs. 100.61 nps., being the amount claimed by him towards damages caused by the petitioners to the plaintiff's crops by allowing water to flow into his land. The plaint averments are briefly as follows. (2) The plaintiff-respondent purchased in February, 1957 the horsegram cropin Acs. 1-25 cents in theland of one valluru Jagannadha Rao near the western channel of Rayakuduru. The petitioners (defendants) are tenants of the adjacent lands of the daughters of one Pemmaraju Gurraju. They raised pillipesara crop, and for watering the said crop they made a gandi in the channel in about March, 1957 and as the water came in large quantities, they let it out by breaching the bund into the crop purchased by the respondent. The brother and the sister brought the present suit for the shares that they were entitled to under the Mohommedan Law, alleging that the widow, the defendant, who had been in possession of the property was divorced by her husband during his life time and as such she was not entitled to any share.The properties in respect of which the plaintiffs ask for their share consists of a house and two survey numbers.
