This is a petition under Article 226 of the Constitution for the issue of a writ of certiorari to quash the notice dated 11-5-1955 issued by the Income-tax Officer purporting to be under Section 31 (4) of the Hyderabad Income Tax Act calling upon the petitioner to show cause why the registration of the partnership should not be cancelled and the order dated 21-9-1955 cancelling the registration of the petitioner's firm. The petitioner further prays for the issue of a writ of mandamus or any other appropriate writ or direction or order and for the refund of the sum of Rs. 75,666-12-0 to the petitioner.2. This is an appeal against the judgment of our learned brother Justice Jaganmohan Reddy dismissing a petition under Article 226 of the Constitution to quash the order of the Government in G. O. Ms. (Rev). 1322 dated 6-5-1953.2. The circumstances constituting the background of this litigation may be briefly related.3. The Thotapallo estate situated in Peddapuram taluk of East Godavary district was held by an ancestor of the parties before us, styled as mokhasa-dar or mansabdar under the zamimkr of Peddapuram to whom he was bound to pay quit-rent as an essential incidence of bis tenure. This estate was declared to be an impartiable estate by the Privy Council in the year 1870. Vide Rajah Yanumula Venkayamah v. Raja Yanumula Boochia Venkondora, 13 Moo Ind App 333 (PC). Bhimasankaram, J.1. This second appeal arises out of a suit instituted by the appellants and their father, Ramabrahmam, who has since died. The suit was for damages for breach of the covenants of title and quiet enjoyment in respect of a piece of land of the extent of 60 cents. There was an exchange deed dated 2-4-1924 whereunder Ramahrahunan, the father of the appellants obtained from the defendant Ac. 1-81 cents in Revision Survey Nos. 675 and 678 plus an amount of Rs. 600/- in exchange for Ac. 15-7 cents in Revision Survey No. 230. Under the deed, there was a covenant for title as well as one for quiet enjoyment.Ever since, each of the parties to the exchange deed was in possession till the year 1929 when one of Ramabrahmam's daughter who was also the defendant's sister's daughter filed O. The prosecution version of the incident is as follows. The accused and the deceased were husband and wife and had four children. After their house in Divitivaripalle was destroyed by fire, the accused, along with the members of his family, migrated to Erlampalle, took on rent the house of P.W. 14 and resided therein. During their stay in that house, the mother of the deceased and a grandchild of the accused died and the deceased for sentimental reasons was pressing her husband to go back to Divitivaripalle.The accused not only did not like that idea but was contemplating to buy the house of P.W. 14.
