Kumarayya, J.1. The Sessions Judge, Karimnagar, has convicted Kasa Boyina Muttiga of Lingapur and Alwala Narasimhulu of Nizamabad under Section 302, Indian Penal Code and sentenced them to death. He has also convicted them under Sections 392 and 457, Indian Penal Code and sentenced them to five years' rigorous imprisonment and 14 years' rigorous imprisonment respectively. The file is before us for confirmation of death sentence. The accused also have filed their appeals against their convictions. This judgment will govern all the three proceedings.2. The facts, according to the prosecution, story are: that the two accused together with one Kottapalli Narasimhulu (the approver), a Harijan of Narlapur, conspired to murder a wealthy old woman, Gudeti Venku, living alone at a distant village, Lingapur in Karimnagar District. I. passed by the Sessions Judge of Guntur. The accused was charged originally under Section 302, I. P. CHANDRA REDDY, J. - These two appeals are against the judgment of the Subordinate Judge, Kurnool, in O.S. No. 52 of 1950 and No. 54 of 1949. The two suits giving rise to these appeals were instituted by the same plaintiffs for the purpose of setting aside some sales. As the subject-matter of the suits was practically the same and the plaintiffs were the same they were tried together and a common judgment was delivered.In O.S. No. 52 of 1950 the first defendant is the Union of India, defendants Nos. 2, 3 and 4 the District Collector, Kurnool, Revenue Divisional Officer, Nandyal, and the Tahsildar, Nandyal, respectively. The two petitioners seeking writs of certiorari had been employed in the Road Transport Department, whose assets and liabilities have since been taken over by the State Road Transport Corporation K. V. Narayana Rao, who has filed W.P. No. 65 of 1957, had been a bus conductor with ten years' service. Abdul Rahim, who has filed W.P. No. 119 of 1957, was a mechanic attached to the City bus deport at Gowliguda, Hyderabad. Both were placed under suspension by two orders of one R. K. Sharman, who was then the mechanical engineer. The orders were of 24 January 1955. Both the petitioners have been later discharged from the service and their appeals against the dismissals have been rejected. The W.P. This appeal arises out of a suit for setting aside the decree passed on 4th Mehar 1317F., and for partition of the matruka property of late Syed Shah Abdul Rahim among his heirs in specified shares according to Mohammedan Law, which has been dismissed by the Darul Khaza Court on 24-9-1351F on the ground that such a suit was not maintainable in law.
