This criminal revision is filed by the accused on the ground that the Magistrate has no jurisdiction to try the case or to take cognizance of the offence after the enactment of Criminal Law Amendment Act, 46 of 1952, and the extension of Corruption Act to Part B States.2. The facts of the case are evident from the challan dated 13-10-1952 filed by the Police against the accused under Section 342, Hyderabad Penal Code, corresponding to Section 409, Indian Penal Code, which states as follows:1. 1. These are six appeals Nos. 433 to 438, Register No. 6 of 1950. The second Magistrate (City Criminal Court), by judgment dated 22nd Bahman 1359 P. convicted the appellants under Sections 48 and 74 of the Hyderabad Companies Act. An appeal was lodged before a single Bench of this Court and it has by judgment dated 5-4-1950, referred the case to this Bench. ORDER1. Heard arguments of the learned advocates of the parties. The charge against the accused is under Sections 353 and 392, Penal Code. Section 353 is bailable. The question now only remains with regard to Section 392 and we have to decide whether in view of the facts of the case the accused should be released on bail or not. The copy of the First Information Report filed before us discloses the facts that the accused is alleged to have stopped one lorry which was carrying bags of grain with the assistance of the other accused, Shabbir, who is not before us; he is alleged to have taken that lorry from Bojgaon to village Ambai and he and the other accused are alleged to have taken away the grain which, it is stated, was found in the house of the other accused, Shabbir. On these facts it was alleged that the accused committed the offence under Section 392. In that offence the punishment provided is of 10 years.
