ORDERSyed Qamar Hasan, J.1. This is a revision petition on behalf of Fatima Sultan arising out of a proceeding under Section 148, Hyderabad Criminal P. C., and the only point involved is whether the Magistrate had erred in computing the period of two months as prescribed by Sub-section (4), Section 148 from the alleged date of dispute and not from the date of the preliminary order,2. The facts shortly stated are that on 23rd Isfandar 1352 P., Rang Rao, the counter-petitioner filed an application in which he alleged that Survey No. 30 situate in Yousufguda belonged to one Lachraa Rao Jagirdar and was under his management and supervision and that Fatima Sultan was attempting to deprive him of its possession forcibly which might result in breach of the public peace.3. The learned Magistrate sent the application to the police for enquiry and report. This revision petition No. 23 of 1953-54 on behalf of Zainulabedeen is directed against the appellate order of Shri Nageshwari Pershad, Sessions Judge of Warangal, who affirmed the judgment of the Magistrate, First Class, Warangal convicting the petitioner of charges under Sections 409 and 477A, Indian Penal Code for criminal breach of trust and falsification of accounts and sentencing him to a term of rigorous imprisonment of one year on each count to run concurrently and also to a fine of Rs. 500/- for each offence in default of the payment of which he was to undergo further three months' rigorous imprisonment for each default.2. Along with this revision, we have to deal with a reference made by the learned Sessions Judge recommending the enhancement of sentence in view of the gravity of the offences and for payment of compensation put of fine to the Postal Department. ORDERM.S. Ali Khan, J.1. This is revision petition No. 54, register No. 6 of 1953. The First Court, City Criminal Courts, by judgment dated 31-3-1953, has fined the revision-petitioner, Mohd. Karim Khan, Rs. 15/- for contravention of Section 338 of the Hyderabad Municipal Corporation Act. Hence this revision petition. I have heard the arguments of the learned advocate, Shri Mohd. Aslam Khan, for the revision-petitioner and Shri Syed Ahmed All Khan for the Hyderabad Municipal Corporation. I record my opinion below.2.
