The Uttar Pradesh Public Service Commission, Allahabad issued an advertisement dated 23.03.2013 inviting applications for various posts for Combined State/Upper Subordinate Services (Gen.Rectt.) Examination-2013 and Combined State/Upper Subordinate Services (Physically Handicapped Special Rectt.)Examination-2013. In this advertisement, applications were invited for several posts such as Dy. Collector, Naib Tehsildar, Treasury Officer/Accounts Officer etc. There were some specific posts for which specific qualifications were prescribed. The minimum qualification for various posts was that the candidate should a graduate but for some specific posts specific qualifications were prescribed. For example, for the post of "Sub Registrar and Asstt. P.O. (Transport)", the essential qualification was Law graduate. 1. Heard Pt. Nawin Sharma (the petitioner) in person, Sri Ishan Shishu for respondent-1 and Sri Sanjeev Singh for respondents-2, 3 and 4. 2. The writ petition has been filed for issuing a writ of prohibition, prohibiting respondents-2 to 4 from proceeding under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, (hereinafter referred to as the Act), till the pendency of the Writ Petition No.53112 of 2013 and Criminal Contempt Application No.13 of 2014. 3. It appears that the petitioner took loan from Union Bank of India, Branch A.D.A. Jaipur House, Agra. On default being committed in payment of instalments of loan by the petitioner, the Bank started proceedings under the Act. The petitioner filed Writ Petition No.53112 of 2013 challenging the constitutional validity of the Act. Heard Sri Mahendra Pratap Singh, learned counsel for the petitioner as well as Sri N.K. Seth, Senior Advocate assisted by Sri Gopal Kumar Srivastava appearing for the respondent-bank. The facts briefly is, that, the petitioner was appointed, Class-IV attender with the respondent-bank in 1981, thereafter, in 1982 he was confirmed. The petitioner was advanced housing loan of Rs. 75,000/- in 1988 and as per the housing scheme, applicable to the employees, the petitioner was required to repay the loan in 24 years, monthly installment being of Rs. 357.15 paisa, to be deducted from his salary. The petitioner purchased the plot/house on 26.4.1988 at Aliganj Housing Scheme, and executed an agreement with the bank undertaking to create equitable mortgage and not to sell, mortgage, alienate or create any charge, without the written permission from the bank.
