This is an appeal at the instance of the Revenue challenging the order of the Customs, Excise & Service Tax Appellate Tribunal, New Delhi dated 7-9-2009 in Excise Appeal No. 2085 of 2009 [2010 (249) E.L.T. 247 (Tri. -Del.)] raising following question:Whether the interest is not recoverable under Rule 14 of the CENVAT Credit Rules, 2004 and penalty not imposable under Rule 15(1) of the CENVAT Credit Rules, 2004, if the inadmissible credit has been reversed before utilization?2.
