1. Proceedings under Section 10(2) of the U.P. Imposition of Ceiling on Land Holdings Act, 1960 (hereinafter referred to as 'Act,1960') were initiated against the present petitioner under a notice issued after the enforcement of Act No. 18 of 1973 in view of amended Section 4-A read with Section 29 of the Act, 1960. The petitioner filed his objections to the notice so issued. The objections were considered and the Prescribed Authority vide order dated 30.07.1983 held that the petitioner had 1.04 acres of irrigated land as surplus. 2. Not being satisfied with the order so passed by the Prescribed Authority, the recorded tenure holder filed an appeal under Section 13 of the Act, 1960. 1. The appellants are in appeal against the judgment and order of the learned Single Judge dated 14.07.2010. The issue before the learned Single Judge was, whether the holders of Moallim-E-Urdu Certificate, which was recognized by the State Government as well as Union of India, and was treated equivalent to B.T.C. Imposition of Ceiling On Land Holdings Act, 1960 (herein after referred to as the Act, 1960) were initiated against the recorded tenure holder (Mohar Singh) culminating in an order of the Prescribed Authority dated 31.03.1980 whereunder it was held that the petitioner had 4.45 acres of irrigated land as surplus.
