ORDER1. By the order dated 20-6-1980 passed in sessions trial No. 232 of 1979 each of the appellants above named has been convicted and sentenced to undergo six months R. M.C. Jain, J.1. The present seven appellants along with one another Hari Ram were put to trial in Sessions Trial No. 244 of 1984 before the Additional Sessions Judge, Ballia. The co-accused Hari Ram died during the pendency of the trial and the case against him abated. The present seven appellants have been convicted and sentenced by Sri S.K. Pandey, the then Additional Sessions Judge, Ballia by the judgment and order dated 6-8-1986. Out of them, Kharpattu, Dharam Deo, Ram Awadh and Satya Narain have been convicted under Section 148, 1.P.C., 302 I.P.C. read with Section 149, I.P.C. 307, I.P.C. read with Section 149, I.P.C. and 323, I.P.C. read with Section 149, I.P.C. N.K. Mitra, C.J. and S.C. Verma, J.1. The Motor Accidents Claims Tribunal, in M.A. Petition No. 501 of 1998, by an award dated 25.10.1999, has awarded compensation of Rs. 1,50,000 to a minor of 10 years, who met an accident with truck No. HR 13-G-0190. The accident had taken place on 7.7.1998 at about 3 p.m. on G.T. Road, when the deceased while crossing the road met with fatal accident. The factum of accident has been held to be proved by the Tribunal, on the basis of F.I.R., post-mortem report and the statements of the witnesses, namely, Ramchandra Vishwakarma and Nokhey Lal Singh. The Tribunal has also held that the vehicle was properly insured and there was a subsisting policy at the time of the accident. The Tribunal has further held that the driver possessed a valid driving licence and the vehicle was having proper registration certificate and permit to ply the vehicle.
