Challenge in this petition is fo-cussed on the communication dated 4.12.2000 (Annexure-1 to the petition) whereby the petitioner who is the Executive Officer in the Nagar Panchayat, Lalgopal Ganj. Allahabad, has been called upon to furnish details of itemised purpose of the sum withdrawn in the financial year 2000-2001 in connection with development work and other allied works within the circle of Nagar Panchayat. It has been specified in the impugned communication that if the petitioner defaults in furnishing details as demanded for requisition by the District Magistrate, the matterwould be forwarded to the State Government/Directorate for appropriate action against the petitioner. The petitioner was Lecturer in Hindi since 1975 in Gyan Bharati Balika Inter College, Birhana, Kanpur Nagar is a recognised and aided institution. Her date of birth is 25.3.1939. She gave an option to retire at the age of 58 years on 31.12.1990 in pursuance of Government Order dated 6.10.1990 circulated by Director on 31.10.1990. She withdrew her option on 26.2.1997. The management recommended on 15.3.1997 to the District Inspector of Schools-II. Kanpur Nagar for permitting the petitioner to change her option. The District Inspector of Schools on 19.4.1997 returned the papers that it should again be sent along with the Government Orders. The petitioner filed Civil Misc. Writ Petition No. 16401 of 1997. This is an application filed by the Commissioner of Income-tax (Central), Kanpur, for a direction to the Income-tax Appellate Tribunal to draw up a statement of the case and refer the questions of law mentioned in paragraph 3 of the application filed by the applicant.2. The assessee is a sharebroker and filed his return of income on December 13, 1994. The assessment was completed under Section 143(3) of the Income-tax Act, 1961. During the course of assessment proceedings, the Assessing Officer had found that the assessee had at times settled the share transactions by corresponding deliveries and at times settled the contract without effecting the delivery. On an examination of invoice bills, the Assessing Officer found that the assessee had earned a profit of Rs. 32,80,949 and suffered a loss of Rs. 1,10,14,010, thereby incurring a net loss of Rs. 77,33,061. This Court by its judgment and order dated 26.11.1992 passed in Civil Misc. Writ Petition' No. 818 of 1992, Ramesh Pratap Singh and Ors. v. State of U.P. has already held that the degree of B.Ed, obtained by correspondence course from the recognised institutions should be treated equivalent to the degree of B.Ed. obtained as regular student for the purpose of B.T.C.
