The services of the petitioner came to be terminated w.e.f. 16.5.1989 on account of closure of the said unit. The gratuity payable to the petitioner was not paid by the employer and, therefore, he staked his claim for gratuity under Section 7 of the Payment of Gratuity Act. 1972 thereinafter referred to as the Act).
