ORDER1. The petition has been filed for quashing of the orders dated 1-10-1993 passed by the D.S.O. Etawah cancelling the licence issued in favour of the petitioner under the U.P. High Speed Diesel and Light Diesel Oil (Maintenance of Supply and Distribution) Order, 1981 (hereinafter referred to as the Order) and also the Appellate Order dated 4-8-1994 passed by the Commissioner. The original record of the proceedings were summoned and the petition is being disposed of finally after hearing counsel for the parties.2. The petitioner's shop was inspected on 4-3-1993 and a sample of Diesel Oil was taken which was sent to Forensic Science Laboratory, U.P. Lucknow on 11-3-1993. After analysis, the Scientific Officer of the Laboratory gave a report dated 6-8-1993 that the sample of the Diesel Oil was found adulterated by a liquid having high boiling fraction and the boiling point was also found to be higher than the standard fixed for high speed Diesel Oil. G.P. Mathur, J.1. This petition has been filed by the Employer for quashing of the award dated January 29, 1993 given in Adjudication Case No. 174/1989 of Labour Court (III) Kanpur. Lal Mohammad, the workman concerned died on November 3, 1991 during the pendency of the adjudication proceedings before the Labour Court, but no one was substituted in his place. His son Mohd. Farooq, however, filed a caveat in the writ petition and also a counter affidavit, though no application was formally moved by him for being impleaded as a party. I have heard learned counsel for the petitioner as well as for Mohd. Farooq and with their consent the writ petition is being disposed of finally at the admission stage.2. The workman, Lal Mohammad was employed in the Cooper Alien Branch of the British India Corporation Ltd. on August 29, 1961 and in the Service Card his year of birth was noted as 1928. Since a long time has elapsed the writ petition is being disposed of finally at the admission stage with the consent of the parties.2. The principal prayer made in the petition is that the reference made by the State Government on October 18, 1986, (Annexure-1 to the writ petition) under Section 4-K of U. P. Industrial Disputes Act be quashed. Sri D. Mittal-respondent No. 3 was employed as Medical Sales Representative in the petitioner Company. His services were terminated w.e.f, March 20, 1985. This petition has been filed for quashing of the order dated 11-1-1994 and 22-2-1994 passed by the Commissioner, Meerut dismissing the appeal preferred by the petitioner against the order dated 15-10-1993 of the District Magistrate cancelling his fire arm licence. The learned Standing Counsel was granted one month's time on 23-3-1994 to file counter affidavit but no such affidavit has been filed. In view of the fact that nearly one year has elapsed, I do not consider it proper to grant any further lime for filing counter affidavit and the writ petition is being disposed of finally at the admission stage.2. A notice was issued to the petitioner to show cause why his fire arm licence be not cancelled.
