Oct. 4, 1985 allowing an application filed by the mother for the interim custody of a minor child, a son aged about 31/2 years at the time of making of the application, having been born on Jan. 12, 1982. The said application was filed in an application filed by the mother of the child under Section 25 of the Guardians and Wards Act for an order for the return of the child from the custody of the applicant who is his father. 2. The question raised on behalf of the Revenue in the instant revision is :Whether, on the facts and in the circumstances of the case, the Sales Tax Tribunal was justified in their majority judgment to hold that the assessee was not liable to any penalty under Section 15-A(1) of the Act in spite of the decision of the High Court in the case of United Traders, Rudrapur v. On receipt of the summons of the aforesaid petition respondent No. 1 made an application for grant of Rs. 200/- per month for pendente lite maintenance and Rs. 500/-as expenses for contesting the petition filed by the applicant on the ground that she was an illiterate lady and had no independent source of income to maintain herself. Hercase was that the applicant was a Mistri and had income of about Rs. 1000/- per month. Camphor and Allied Products Limited, Cluter-buckganj, Bareilly, which has been buying 85 per cent of total vegetable turpentine oil produced by the assessee since the year 1964 and the same is being used as raw material for the manufacture of camphor and its bye-products.
