The Income-taxAppellate Tribunal, Delhi Bench, (hereinafter referred to as ' the Tribunal') has submitted a statement of the case and referred the following question of law at the instance of the assessee, Messrs. Agarwal and Co. (hereinafter referred to as ' the assessee ') under Section 66(1) of the Income-tax Act, 1922 (hereinafter referred to as the 'Act') :' Whether on the facts and in the circumstances of the case, registration was rightly refused to the firm on the ground that it violated the provisions of Section 4 of the Indian Companies Act, 1913 ?'2. The assessment years in question are 1952-53, 1953-54 and 1954-55.3. Messrs Gangaram Sitaram of Hathras have filed Writ Petitions Nos. 29 and 979 of 1967 challenging the assessment orders made by the Sales Tax Officer, Hathras, for the quarters ending 30th June, 1966, and 30th September, 1966. The petitioner Sheo Charan Das Sharma filed a petition under Article 226 of the Constitution praying for a writ of certiorari for quashing certain resolutions passed by the first respondent, the Regional Transport Authority, Meerat. He further prayed for a writ in the nature of; mandamus commanding the second respondent, the Secretary, Regional Transport Authority, Meerut, not to issue any temporary permits to opposite party-respondents 3 to 14. Satish Chandra, J., who heard the matter, referred the following question for decision to a large Bench: 'Is a rival operator entitled to maintain a writ petition to challenge a temporary permit granted to another operator?' 2. ORDERRajeshwari Prasad, J.1. Both the petitioners have been convicted under Sections 7/16 Prevention of Food Adulteration Act. The sentence awarded to Sri A. K. Chakra-varty is that of a fine of Rs. 2,000 and in default to undergo rigorous imprisonment for one year. The sentence awarded to Sri A. K. Bhattacharya petitioner is also that of a fine of Rs. 1000 only and in default to undergo six months' rigorous imprisonment.2. This is a petition under Article 226 of the Constitution for a writ of quo warranto calling upon the respondents 2 to 16 to show cause by what authority they are holding the office of the District Judges and to oust them from the offices.2. The present petition is a concomitant of the Supreme Court decision in an earlier writ petition filed by the petitioner in this Court, Chandra Mohan v. State of U. P., AIR 1966 SC 1987. On 8th August, 1966, the Supreme Court reversed the decision of this Court. It declared that the U. P. Higher Judicial Service Rules (which I shall hereinafter called 'the rules') providing for the recruitment of District Judges are constitutionally void, because they infringe Article 233 of the Constitution and therefore the appointments made thereunder were illegal. Bengal Hemp Supply Company for recovery of certain amount of money as damages for breach of contract for supply of forty tons of specified quantity of a material described as New Indian hemp rope cuttings. It is not necessary for the purposes of deciding this appeal to state the facts relating to the contract and the alleged failure on the part of the M/s. S.N. Singh, J.1. This appeal arises out of a suit brought by the plaintiffs for the redemption of a mortgage with possession in respect of a shop situate in erstwhile Tehri Garhwal State. The suit was filed on the 2nd of September, 1951, The plaintiffs' case was that they had mortgaged a shop in favour of Kabool Chand and Fateh Chand for a consideration of Rs. 1,600/- on the 29th of August, 1931, and had put the mortgagees in possession over the same. It was alleged that the mort--gage was for a period of eight years and it was stipulated in the mortgage deed that the mortgagors would not redeem in the first four years and that after the expiry of four years they would be entitled to redeem the mortgage at any time.
