ORDERS.S. Dhavan, J.1. This is a decree-holders application under Section 115 of the Code of Civil Procedure against an order of the Additional District Judge Agra confirming that of the execution court upholding the judgment-debtor's objection against the attachment of his salary. The applicant Sheo Baran Singhobtained a money decree against the respondent Mohan Lal and got a portion of Mohan Lal's salary attached. (Mohan Lal's salary was Rs. 176 per month and therefore only Rs. 38 were attached). The decree was passed in March 1962 and the salary was attached on 20th March 1963. Presumably in pursuance of the attachment order, the salary was attached as it accrued from month to month.2. On 4th September 1963, Parliament passed the Code of Civil Procedure Amendment Act (No. 36 of 1963) amending Clause (1) of Section 60 of the Code and raising the exemption limit in case of salary from one hundred to two hundred rupees. C. the petitioner challenges the validity of his detention in the district jail at Agra in pursuance to an order passed by the civil authority, Agra, under the provisions of para. 5/8 of the Foreigners' (Internment) Order, 1962, as applicable to Pakistani nationals in India.2. The undisputed facts which are relevant to the questions in controversy are these.The petitioner who was born at Agra migrated to Pakistan in the year 1955. Some time in the year 1961 he entered India on the basis of a Pakistani Passport No. 593116 dated the 29th April 1959, and a short term visa No. 10488 dated February 1961 and has been over-staying since then at Agra in spite of the expiry of the period mentioned in the visa. This criminal revision has been filed by two persons who have been convicted under Section 420 I.P.C. and each of them sentenced to six months' R.I. and a fine of Rs. 250, in default three months' further R.I.2. On 3.5.1962 the applicants entered into an agreement with the complainant by which they agreed to crush their sugarcane at his Bel (sugarcane crusher) and supply sugarcane juice to him. On this representation they obtained an advance of Rs. 800 from the complainant. The supply of sugarcane was to begin in October 1962 and was to continue until March 1963. The prosecution case was that the applicants failed to cruch sugarcane at the Bel of the complainant and instead supplied sugarcane to the Co-operative Cane Society under an agreement dated 17.10.1962 at a premium.3.
