This is a plaintiffs' second appeal from the decree of the Temporary Civil and Sessions Judge of Mathura dismissing their suit for the ejectment of the defendant respondent and recovery of arrears of rent from him as well as damages for unauthorised use and occupation of the premises in suit. The facts are these. The plaintiff is a deity, Shri Thakur Govind Deoji Rirajman, whose idol is established in a temple at Barsana in the district of Mathura The suit was filed in the name of the deity but the plaintiff was described as under the management of Nand Ram and others who were styled as managers (Mohatiman) of the deity. They were also added in the array of plaintiffs. The defendant is one Susalli a tenant of the deity. ORDERGyanendra Kumar, J.1. The applicants have been convicted under Section 147, I. P.C. and Section 7 of the Untouchability (Offences) Act. 1955 and sentenced to pay a fine of Rs. 100 and Rs. 50 respectively under the above counts and in default to undergo one month's simple imprisonment.2. The prosecution case briefly is that on the 5th of May., 1961, P. W. Puran Singh, who is Dom Harijan by caste and Thakur Matbar Singh went together to village Bhatkoti. The Thakur was thirsty, so he asked his companion to get some water. Accordingly Puran Singh fetched and gave water to him. The giving of water by a Harijan to a Thakur was disliked by the accused, who are Thakurs by caste, with the result that a Panchayat was held at the house of Bisheshwar Prasad (applicant No. l) on 7-5-1962. This writ petition is directed against an order of the Executive Engineer, Hydro Electric Division, Budaun, terminating the petitioner's services as Sub-Station Attendant under him with effect from 30th November 1962, 2. The undisputed facts of the case which are relevant to the questions in controversy may be stated briefly. 3. By an order, dated 3rd of December 1951 passed by the Superintending Engineer, Hydel (Ganga) Circle, Roorkee, the petitioner was appointed as an officiating Meter Reader, Hydel Division, Bulandshahr and he joined service as such on the 12th of December, 1951. It has been found as a matter of fact by the Settlement Officer and also by the Deputy Director that the contesting respondents alone were actually in possession as khudkasht-holders and that the appellants were not. Only the respondents were recorded as khudkasht-holders, and the Settlement Officer found as a matter of fact that the entry was correct; this means that he did not find the appellants to be in actual or clutivatory possession of the land in dispute. He, however, treated them as khudkasht-holders, and subse-questly as bhurnidhars, merely because he thought that cultivatory possession of a co-proprietor was cultivatory possession of all co-proprietors. There never was any such law. Khudkasht rights were derived from cultivatory possession and not from possession over proprietary rights. This is a tenant's second appeal from the concurrent decisions of the courts below decreeing the plaintiff respondentssuit for his ejectment and recovery of arrears of rent from him. 2. The appellant Riyasat AH Khan was a tenant of a house in Moradabad of which the plaintiff respondent Mirza Wahid Beg is the Owner and landlord. The latter filed a suit for his ejectment on the ground that he had illegally sub-let a portion of the house and also failed to pay arrears of rent within one month of receiving a notice of demand. Both the courts below rejected the allegation of sub-letting, but have held that the appellant had not paid rent for more than three months in spite of demand.
