M. C. DESAI C.J. - The Income-tax Appellate Tribunal (Delhi Bench 'B') has at the assessees instance submitted to this court a statement of the case giving rise to the following questions of law :'1. Whether there was any evidence to support the finding that the assessee was guilty of concealing the particulars of his income within the meaning of section 28(1)(c) of the Indian Income-tax Act 2. Whether, on the facts and circumstances of the case, the imposition of the penalty was justified in law ?'The facts as they appear from the statement are these. The assessee is a registered firm consisting of three partners, one being Haji Abdul Qayum. It submitted a return of its income for the assessment year 1948-49; during the assessment proceedings the income-tax Officer came across an entry of Rs. 76,047-8-0 in the personal account of Haji Abdul Qayum, partner. In the petition Abdul Ahad seeks certiorari for the quashing of an order passed by the Superintendent of Police Bareilly, on 17-4-1961 compulsorily retiring him from the post of a head constable and mandamus requiring the Deputy Inspector General of Police and the Inspector General of Police not to terminate his services.2. The petitioners are the owners of a house in the town of Deorla. At the relevant time the petitioner No. 1 was living in a portion of the building and the other portion was tenanted by A. N. Chauhan, an Assistant Engineer in the Public Works Department of the State Government.3.
