ORDERSeth, J.1. The applicants, Iqbal Ahmad and Ali Ahmad, have been ordered to execute personal bonds with two sureties each to be of good behavior under Section 110, Criminal P. 0., on a finding that they were so desperate and dangerous as to render their being at large without security hazardous to the community. They appealed against this order to the Sessions Judge of Azamgarh. Their appeal was also dismissed on 10th September 1947. They have come up in revision to this Court against the appellate order of the learned Sessions Judge.2. It has been contended on their behalf that all that the facts found against them establish is that- they are bullies and that this does not justify an order under Section 110 (f), Criminal EC.3. Agarwala, J.1. Haanu, Earn Autar and Bhullar, Ahirs, all residents of village Marhun and Ramlal resident of Malakharhar and Pudai resident of village Mohammadpur along with six other Ahirs were prosecuted for offences under Sections 302, 147, 485/149 and 201/149, Penal Code. Haanu, Earn Autar, Bhullar, Eamlal and Pudai have been convicted by the learned Additional Sessions Judge of Allahabad under all those sections and sentenced each to transportation for life under Section 302, Penal Code and to one year's rigorous imprisonment under Section 147, two years' rigorous imprisonment under Section 435 and three years' rigorous imprisonment under Section 201, Penal Code. The trial for the offence under Section 201, Penal Code was with the aid of a jury. The other six accused have been acquitted. The above named five accused have come up in appeal to this Court.2. ORDERAgarwala, J.1. This is a reference arising out of proceedings under Section 145, Criminal P. 0., initiated by Mt. Gian Devi against Atma Singh who claimed himself to be the chela of Chetan Deva.2. The property in dispute is a house situated in Risikesh. It consists of eleven kothris, five .of which are in the possession of tenants. It appears that this house was owned by one Sant Chetan Deva. Chetan Deva died on 23rd December 1945. It is admitted that Mt. Gian Devi used to live in this house with Chetan Deva. Atma Singh alleges that Chetan Deva executed a will .in his favour. This will, dated I6th December 1945, has been produced and is on the record. According to Atma Singh the house was bequeathed to him by Chetan Deva under this will and on the litter's death he was installed as a Mahant by the other Mahants of his brotherhood.3.
