West Bengal Municipal Act, 1993 Complete Act

.....milk- shop or other place (a) from which milk is supplied on, or for, sale, or (b) in which milk is kept for the purposes of sale or used for manufacture or preparation for sale of (i) butter, or (ii) ghee, or (iii) cheese, or (iv) curds, or (v) dried, sterilized, condensed or toned milk, but does not include (a) a shop or other place in which milk is sold for consumption of the premises only, or (b) a shop or other place from which milk is sold or supplied in hermetically closed and unopened receptacles in the same original condition in which it was first received in such shop or other place; (14) "dairyman" includes any occupier of a dairy, or any cow-keeper who trades in milk, or any wholesale or retail seller of milk; (15) "dangerous disease" means (a) cholera, plague, small-pox, cerebro-spinal meningitis, diphtheria, tuberculosis, leprosy, influenza, encephalitis, poliomyelitis and syphilis; and (b) any other epidemic, endemic, or infectious disease which the State Government may, by notification, declare to be a dangerous disease for the purposes of this Act; 44. .....1994. . (1) No civil court shall have any jurisdiction to entertain or decide any question relating to matters arising under any provision of this Act or the rules made thereunder. (2) Every order passed by the authorised officer which is subject to appeal or revision, every order passed by the authority referred to in sub-section (1) of section 5, and every order passed by the officer referred to in section 6, which is subject to revision, and every order passed by the State Government in revision, shall be final and shall not be questioned in any court of law. Section 13 Penalties Any promoter who fails to comply with, or contravenes, any of the provisions of this Act or the rules made thereunder, shall, on conviction, be punished with imprisonment for a term, not being less than three months, which may extend to three years or with fine which may extend to five thousand rupees or with both, and a promoter who commits a criminal breach of trust in respect of any sum of money as advance payment or deposit, referred to in section 7, shall, on conviction, be punished with imprisonment for a term, not being less than six months, which may extend to four years or with fine.....

.....or in any decree or order of any court, tribunal or other authority, nothing contained in the Transfer of Property Act, 1882, or the Indian Contract Act, 1872, or the West Bengal Premises Tenancy Act, 1956, shall apply, or shall be deemed ever to have applied, to any transfer of Government land to a lessee, either by lease or by any other instrument, by or on behalf of the State Government, and such transfer of Government land shall take effect, and shall be deemed always to have taken effect, as if the Transfer of Property Act, 1882, or the Indian Contract Act, 1872, or the West Bengal Premises Tenancy Act, 1956, has not been passed. Section 4 Bar to registration of document Notwithstanding anything contained in the Registration Act, 1908, no registering officer shall register any document relating to the transfer of Government land, held by any lessee on lease, in favour of any person, not being the State Government or a Government undertaking, except with the permission granted by the competent authority in writing in this behalf. .....referred to as the principal Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Amendment of section 49A of Act 1 of 1894 In section 49A of the principal Act as amended by the Land Acquisition (West Bengal Amendment) Act, 1986, after sub-section (2), the following sub-section shall be inserted : (3) The provisions of this section shall apply to a multi-storeyed building where the State Government or the Central Government or any Government undertaking, State or Central, has been occupying any portion of any floor or any flat for the purpose of its office, either as a monthly tenant or otherwise, and intends to retain such floor or flat, as the case may be, permanently under occupation, in any area within (a) Calcutta as defined in clause (9) of section 2 of the Calcutta Municipal Corporation Act, 1980, or (b) Howrah as defined in clause (15) of section 2 of the Howrah Municipal Corporation Act, 1980, to the exclusion of any other area in West Bengal, notwithstanding anything contained elsewhere in this Act or in any other law for the time being in force.
