Title: Liability of Manufacturers, Packers, Wholesalers, Distributors and Sellers

(1) The manufacturer or packer of an article of food shall be liable for such article of food if it does not meet the requirements of this Act and the rules and regulations made thereunder, (2) The wholesaler or distributor shall be liable under this Act for any article of food which is-- (a) supplied after the date of its expiry; or (b) stored or supplied in violation of the safety instructions of the manufacturer; or (c) unsafe or misbranded; or (d) unidentifiable of manufacturer from whom the article of food have been received; or (e) stored or handled or kept in violation of the provisions of this Act, the rules and regulations made thereunder; or (f) received by him with knowledge of being unsafe. (3) The seller shall be liable under this Act for any article of food which is-- (a) sold after the date of its expiry; or (b) handled or kept in unhygienic conditions; or (c ) misbranded; or (d) unidentifiable of the manufacturer or the distributes from whom such articles of food were received; or (e) received by him with knowledge of being unsafe.

1[(1) Government may by notification in the Bombay Government Gazette determine a limit of quantity within which and beyond which the sale of any excisable article or hemp shall be deemed to be sold by retail and wholesale respectively; such limit may be fixed with respect to the whole Presidency of Bombay or any local area, and with respect to purchasers generally or to any specified class of purchasers, and with respect to any specified occasion or generally. (2) When any such limit of quantity has been prescribed for the retail sale of any excisable article or hemp, no quantity in excess of such limit shall be sold by retail to any one person at one time or to any one person in the aggregate on any one day : Provided that the Collector or any Abkari officer duly empowered in this behalf may, subject to any rules that may be made under section 35-A give special orders for the occasional sale by retail of any excisable article or hemp in quantities exceeding such limits.] ___________ 1. .....Committee appointed by the Legislative Assembly was of the opinion that a more comprehensive measure, providing for the uniform control of manufacture and distribution of drugs as well as of import, was desirable. The Government of India accordingly asked Provincial Governments to invite the Provincial Legislatures to pass resolutions under section 103 of the Government of India Act, 1935, empowering the Central Legislature to pass an Act for regulating such matters relating to the control of drugs as fall within the Provincial Legislative list. Such resolutions have now been passed by all Provincial Legislatures. Chapter II of the Bill establishes a Board of Technical Experts to advise the Central and the Provincial Governments on technical matters. Chapter III provides for the control of the import of drugs into British India. The executive power under this Chapter will accordingly be exercised by the Central Government. Chapter IV relates to control of the manufacture, sale and distribution of drugs and contains the provisions which it is proposed should be enacted in exercise of the power conferred by the resolutions under section 103 of the Government of India Act,.....
