In section 32 of the Income-tax Act, with effect from the 1st day of April, 1981, - (a) in sub-section (1), after clause (ii), the following clause shall be inserted, namely :- '(iia) in the case of any new machinery or plant (other than ships and aircraft) which has been installed after the 31st day of March, 1980, but before the 1st day of April, 1985, a further sum equal to one-half of the amount admissible under clause (ii) (exclusive of extra allowance for double or multiple shift working of the machinery or plant and the extra allowance in respect of machinery or plant installed in any premises used as a hotel) in respect of the previous year in which such machinery or plant is installed or, if the machinery or plant is first put to use in the immediately succeeding previous year, then, in respect of that previous year : Provided that no deduction shall be allowed under this clause in respect of - (a) any machinery or plant installed in any office premisses or any residential accommodation; (b) any office appliances or road transport vehicles; and (c) any machinery or plant, the whole of the actual cost of which is allowed as a deduction (whether by way of.....

Title: Term of Office of and Vacancies Among Members

(5) An outgoing member other than a member elected under clause (I) of section 5 shall, unless the Central Government otherwise directs, continue in office until another person is nominated as a member in his place. (8) The interim payment made to an existing bank under sub-section (7) shall be set off against the total amount payable to such existing bank under this Act and the balance of the amount remaining after each payment shall be given to the existing bank in accordance with the option exercised, or deemed to have been exercised, under subsection (4) or sub-section (5), as the case may be: Provided that where any part of the interim payment is obtained by an existing bank in cash, the payment so obtained shall be set off, in the first instance, against the first installment of the cash payment referred to in sub-section (2), and in case the payment so obtained exceeds the amount of the first installment, the excess amount shall be adjusted against the second instalment and the balance of such excess amount, if any, against the third installment of the cash payment.

Title: Central Government or the Government Company, Not to Liable for Certain Prior Liabilities

.....or in relation to any share held by it in a specified company, in respect of any period prior to the appointed day, shall be enforceable against the Central Government, or, where the undertakings of the Company are directed, under section 7, to vest in a Government company against such company; (b) no award, decree or order of any court, tribunal or other authority in relation to the undertakings of the Company, or in relation to any shared held by the Company in specified passed after the appointed day, in respect of any matter, claim or dispute, which arose before that day, shall be enforceable against the Central Government, or where the undertakings of the Company are directed, under section 7, to vest in a Government Company, against Government company; (c) no liability incurred by the Company before the appointed day, for the contravention of any provision of law for the time being in force, shall be enforceable against the Central Government, or, where the undertakings of the Company are directed, under section 7, to vest in a Government company, against such company.

(7) A claimant who is dissatisfied with the decision of the Commissioner may prefer an appeal against the decision to the principal civil Court of original jurisdiction within the local limits of whose jurisdiction the registered office of the concerned company is situated: Provided that where a person who is a Judge of a High Court is appointed to be the Commissioner, the appeal, shall lie to the High Court at Calcutta and such appeal shall be heard and disposed of by not less than two Judges of that High Court. Section 20 - Disbursement of money by Commissioner to claimants After admitting a claim under this Act, the amount due in respect of such claim shall be paid by the Commissioner to the person or persons to whom such amount is due, and on such payment, the liability of the Company in respect of such claim shall stand discharged.
