Official Secrets Act, 1923 Section 6

Title: Unauthorised Use of Uniforms, Falsification of Reports, Forgery, Personation and False Documents

.....fails to restore it to the person or authority by whom or for whose use it was issued, or to a police officer; or (c) without lawful authority or excuse, manufactures or sells, or has in his possession for sale, any such die, seal or stamp as aforesaid, he shall be guilty of an offence under this section. (3) A person guilty of an offence under this section shall be punishable with imprisonment for a term which may extend to1[three years], or with fine, or with both. (4) The provisions of sub-section (2) of section 3 shall apply, for the purpose of proving a purpose prejudicial to the safety of the State, to any prosecution for an offence under this section relating to the naval, military or air force affairs of Government, or to any secret official code in like manner as they apply, for the purpose of proving a purpose prejudicial to the safety or interests of the State, to prosecutions for offences punishable under that section2[***]. _____________________ 1. Cantonments (House-accommodation) Act, 1923 Section 6

Title: Conditions on Which Houses May Be Appropriated

.....on such date, not being less than three clear days from the service of the notice, and at such time between sunrise and sunset, as may be specified in the notice. (2) On the date and at the time so specified the owner shall be bound to afford all reasonable facilities to the person specified in the notice for the purpose of the inspection, measurement and survey of the house and if he refuses or neglects to do so, such person may, subject to any rules made under this Act, enter on the premises and do all such things as may be reasonably necessary for the said purpose.] ________________________ 1. Cotton Transport Act, 1923 [Repealed] Section 6

Title: Penalties

Any person who, in contravention of the provisions of this Act or of any notification or rule made hereunder, knowingly takes delivery of any cotton from a notified station or imports, or attempts to import, any cotton into a protected area, and any station master or other railway servant who, in contravention of the provisions of sub-section (1) of section 5, without reasonable excuse, the burden of proving which shall lie upon him, delivers any cotton to a consignee or other person, shall be liable to a fine not exceeding one thousand rupees, and upon any subsequent conviction to imprisonment which may extend to three months, or to fine which may extend to five thousand rupees, or to both.

Title: Liability of Ships to For-feiture

Any ship which has been, either wholly or partly, built, altered armed, or equipped as a vessel of war in the States in contravention of section 3, or in any {The word " other " omitted by the A.O.1950.} part of His Majesty's Dominions or {Substituted by the A.O.1950, for " any State in India ".} [of India] in contravention of any like provision of law in force in that part {The words " or State " omitted, by the A.O.1950.) shall, if found in the States, be liable to forfeiture under this Act.

EMPLOYEE'S COMPENSATION ACT, 1923 Section 6

Title: Review

(1) Any half-monthly payment payable under this Act, either under an agreement between the parties or under the order of a Commissioner, may be reviewed by the Commissioner, on the application either of the employer or of the 1[employee] accompanied by the certificate of a qualified medical practitioner that there has been a change in the condition of the workman or, subject to rules made under this Act, on application made without such certificate. (2) Any half-monthly payment may, on review under this section, subject to the provisions of this Act, be continued, increased, decreased or ended, or if the accident is found to have resulted in permanent disablement, be converted to the lump sum to which the workman is entitled less any amount which he has already received by way of half-monthly payments. ______________________ 1. Title: Prohibition of Use of Unregistered or Uncertificated Boiler

Mussalman Wakf Act, 1923 Section 6

Title: Audit of Account

Every statement of accounts shall, before it is furnished to the Court under section 5, be audited-- (a) in the case of a wakf the gross income of which during the year in question, after deduction of the land-revenue and cesses, if any, payable to the Government, exceeds two thousand rupees, by a person who is the holder of a certificate granted by the { Subs.by the A.O.1937 for "L.G.".} Central Government] under section 144 of the { The relevant provisions of the Companies Act.1936 (1 of 1.956) may now be referred to.}Indian Companies Act, 1913, or is a member of any institution or association the members of which have been declared under that section to be entitled to act as auditors of companies throughout the { Subs. by the A.O.1950 for " Provinces ".}[territories to which this Act applies]. or (b) in the case of any other wakf, by any person authorised in this behalf by general or special order of the said court.{ In the application of the Act to Bombay, new sections.6A to 6Q have been ins. by the Mussalman Wakf (Bombay Amendment) Act, 1985 (Bom.18 of 1935)section.5 }

Section 36 - Further provisions respecting rules (1) The power to make rules under section 35 shall be subject to the condition of the rules being made after previous publication and of their not taking effect until they have been published in the 1 [Official Gazette] and in such other manner (if any) as the 1 [Central Government] may direct. (4) In making any rule under clause (b) of sub-section (2) of section 35, the 1 [Central Government] may direct that whoever obstructs any person, not being a public servant within the meaning of section 21 of the Indian Penal Code, in making any entry, inspection, measurement or survey, shall be punishable with fine.....
