Title: Remission of Tax in Case of Vacancies when Obligatory

.....wholly or in great part demolished or destroyed by fire or otherwise deprived of value, the municipal council may remit or refund such portion, if any, of the tax or cess or instalment as it may think equitable: Provided that no such remission under this section shall be granted unless notice in writing of the fact of the building or land being vacant and unproductive of rent has been given to the municipal council, and that no remission or refund shall take effect for any period previous to the day of the delivery of such notice: Provided further that no land, building or tenement shall be deemed vacant if maintained as a pleasure resort or town or country house or be deemed unproductive of rent if let to a tenant who has a continuing right of occupation thereof, whether he is in actual occupation or not. .....not disqualified for being aCouncillor] in the case of other 6 [municipal councils] shall, notwithstanding anything contained in this Act or in the rules or orders issuedthereunder, perform the functions of the president. (6) Every president who, for a period exceeding two months and everyvice-president who for a period exceeding one month, absents himself from the 6 [municipal area] in such manner as to be unable to perform his duties as such president or vice-president, shall cease to be president or vice-president, unless leave so to absent himself has been granted by the municipal council. The question whether a vacancy has arisen under this sub-section shall be decided by the Deputy Commissioner. (7) Leave under sub-section (6) shall not be granted for a periodexceeding six months. Title: Removal or Suspension of Members

.....a member of Parliament or any State Legislature or any local authority; or (e) in the opinion of the State Government,- (i) has refused to act; or (ii) has become incapable of acting; or (iii) has so abused his position as a member as to render his continuance on the Board detrimental to the interests of the general public; or (iv) is otherwise unfit to continue as a member; or (f) is convicted of an offence involving moral turpitude. (2) The State Government may suspend any member pending an inquiry against him. Section 65 - Power of Civil Court to refer questions of jurisdiction to High Court (1) If, in any suit instituted or in any appeal presented in a Civil Court, the Judge doubts whether he is precluded by this Chapter from entertaining and disposing of the suit or appeal, he may refer the matter to the High Court. (1) This Act may be called the1[Karnataka] Municipalities Act, 1964. (2) It extends to the whole of the1[State of Karnataka].
