Title: Charges for Energy to Be Made Without Undue Preference

(1) A licensee shall not, inmaking any agreement for the supply of energy, show under preference to anyperson 1 [***] (2) No consumer shall, exceptwith the consent in writing of the licensee, use energy supplied to him under one method of charging in a mannerfor which a higher method of charging is inforce. 2 [(3) In the absence of anagreement to the contrary, a licensee may charge for energy supplied byhim to any consumer- (a)by the actual amount of energy so supplied, or (b)by the electrical quantity contained in the supply, or (c)by such othermethod as maybe approved by the State Government. (4) Any charges made by alicensee under clause (c) of sub-section (3) may be based upon, and vary in accordance with, any one or more ofthe following considerations, namely- (a)the consumer's load factor, or (b)the power factor of hisload, or (c)his total consumption of energy during any stated period, or (d)the hours at which the supply of energy is required.] ____________________________ 1. Title: Regulation of Dividends on Preference Shares in Certain Cases

.....the stipulated dividend in the cases refereed to in sub-section (1), or (ii) by eleven per cent of the stipulated dividend in the cases referred to in sub-section (3). (5) For the purposes of sub-section (1), sub-section (3) and sub-section (4), any reference therein to the stipulated dividend shall, in respect of a preference share issued and subscribed for on or before the 31st March, 1959, be construed as a reference to the stipulated dividend as on that day. (6) For the removal of doubts, it is hereby declared that nay reference in this section and section 4A to deduction made form a dividend on account of income-tax payable by the company does not include nay amount deducted by the company from the dividend under Section 194 of the Income-tax Act, 1961 (43 of 1961).
