THE INDIAN TREASURE-TROVE ACT, 1878 [Act, No. 6 of 1878] [13th February, 1878] PREAMBLE An Act to amend the law relating to Treasure-trove. WHEREAS it is expedient to amend the law relating to treasure-trove; It is hereby enacted as follows:

The Kerala Treasure Trove Act, 1968 [1] Complete Act

.....abetting offence under section 18.- If the owner of the place in which any treasure trove is found abets, within the meaning of the Indian Penal Code (Central Act 45 of 1860), an offence under section 18, the share of such treasure trove or the money in lieu thereof to which he would otherwise be entitled, shall vest in the Government, and he shall on conviction before a Magistrate, be punishable with imprisonment which may extend to six months, or with fine or with both. 20. .....extended to the Hyderabad and Saurashtra areas of the State of Bombay. SECTION 03: CONSEQUENTIAL AMENDMENTS TO ACT NO. VI OF 1878 In the principal Act, (1) in section 1, (i) to the second paragraph the following proviso shall be added, namely : "Provided that on the commencement of the Indian Treasure Trove (Extension to Hyderabad and Saurashtra areas of Bombay State) Act, 1957, this Act shall also extend to, and be in force in, the Hyderabad and Saurashtra areas of the State of Bombay."; (ii) against the proviso so inserted the marginal note "commencement in certain areas" shall be inserted; (2) after section 21, the following section shall be inserted, namely: "22. Repeals and savings : The Hyderabad Treasure-Trove Act, 1322 F and the Indian Treasure Trove Act, 1878, as modified and applied by the State of Saurashtra (Application of Central and Bombay Acts) Ordinance, 1948, are hereby repealed : Provided that notwithstanding such repeal, anything done or action taken (including any notice or security given, any forfeiture, determination, declaration, delivery, division, acquisition or order made, all rights, obligations and liabilities acquired, accrued or incurred, penalties.....

Section 17 - Deputy Commissioner to exercise powers of Civil Court The Deputy Commissioner making any enquiry under this Act may exercise any power conferred by the Code of Civil Procedure, 1908 (Central Act V of 1908), on a Civil Court for the trial of suits. (Hyderabad Act IIIof 1322 F.), as in force in the 1 [Gulbarga Area], are hereby repealed: Provided that section 6 of the1 [Karnataka] General Clauses Act, 1899 (1 [Karnataka] Act III of 1899), shallbe applicable in respect of the repeal of the said enactments and sections 8and 24 of the said Act shall be applicable as if the said enactments had beenrepealed and re-enacted by this Act _______________________ 1.
