Title: Transaction of Business by the Municipal Council

.....meeting that a resolution has been carried or lost, and an entry to that effect in the minutes of the proceedings shall, for the purposes of this Act, be conclusive evidence of the fact without proof of the number or proportion of the votes recorded in favour of or against such resolution. Title: Transaction Resulting in Dissipation of Assets

(4) Where an application is made to the Tribunal under this section in respect of any transaction and the application is determined in favour of the Government, the Tribunal shall have exclusive jurisdiction to determine any claims outstanding in respect of the transaction. Title: Inquiry Regarding Illegal Transactions

Section 83 - Inquiry regarding illegal transactions The prescribed authority shall, after a summary inquiry, determine whether the transaction reported to it under section 82 or coming to its notice in any other manner is in contravention of1[or is unlawful or invalid under] the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] and make a declaration accordingly. Any transaction so declared to be in contravention of1[or is unlawful or invalid under] any of the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] shall be null and void.2[The land in respect of which such transaction has taken place shall, as penalty, be forfeited to and vest in the State Government3[free from all encumbrances]. Title: Power of State Government to Declare Certain Transactions Void

(1) The State Government may declare void any transaction in connection with which a member has been removed under1[x x x] clause (e) of sub-section (1) of section 6 after considering the report on the facts of the case made to it by a District Judge nominated by it in this behalf. (2) A District Judge nominated under sub-section (1) shall, before making his report under that sub-section to the State Government in relation to any transaction, give all parties interested in the transaction a reasonable opportunity of being heard. (3) Where a transaction is declared void under this section it shall not be enforceable by any party to the transaction but the provisions of section 65 of the Indian Contract Act, 1872, shall, so far as may be, apply to such transaction as they apply to an agreement which is discovered to be void or a contract which becomes void. (4) The decision of the State Government declaring any transaction void under this section shall be final and shall not be called in question in any Court. __________________________ 1. Title: Reopening of Transactions

Notwithstanding anything contained in any law for the time being in force, the Court shall, in any suit to which this Act applies, whether heard ex parte or otherwise,-- (a) reopen any transaction, or any account already taken between the parties; (b) take an account between the parties; (c) reduce the amount charged to the debtor in respect of any excessive interest; (d) if on taking accounts it is found that the money-lender has received more than what is due to him, pass a decree in favour of the debtor in respect of such amount: Provided that in the exercise of these powers, the Court shall not,- (i) reopen any adjustment or agreement purporting to close previous dealings and to create new obligations which have been entered into by the parties or any person through whom they claim at a date more than six years from the date of the suit; (ii) do anything which affects any decree of a Court. Explanation.--For the purpose of this section "excessive interest" means interest at a rate which contravenes any of the provisions of section 28.

Title: Several Instruments Used in Single Transaction of Sale, Mortgage or Settlement

(1) Where, in the case of any sale, mortgage or settlement, several instruments are employed for completing the transaction, the principal instrument only shall be chargeable with the duty prescribed in the Schedule for the conveyance, mortgage, or settlement and each of the other instruments shall be chargeable with a duty of1[one hundred] rupees instead of the duty (if any) prescribed for it in the Schedule.
