GOVERNMENT OF INDIA ACT, 1915-191 Preamble2 An Act to consolidate enactments relating to the government of India. whereas it is the declared policy of Parliament to provide for the increasing association of Indians in every branch of Indian administration, and for the gradual development of self-governing institutions, with a view to the progressive realisation of responsible government in British India as an integral part of the empire: AND WHEREAS progress in giving effect to this policy can only be achieved by successive stages, and it is expedient that substantial steps in this direction should now be taken: AND WHEREAS the time and manner of each advance can be determined only by Parliament, upon whom responsibility lies for the welfare and advancement of the Indian peoples: AND WHEREAS the action of Parliament in such matters must be guided by the co-operation received from those on whom new opportunities of service will be conferred, and by the extent to which it is found that confidence con be reposed in their sense of responsibility: AND WHEREAS concurrently with the gradual development of self-governing institutions in the provinces of India it is.....

Title: If the Board Are of Opinion That Any Matters Wherein Indian or Other States Are Concerned Require Secrecy, the Board May Send Official Communications Through Secret Committee

.....to such princes or states intended to be communicatedinorders,dispatches, official letters or communications, tc any of the governments orpresidencies in India, or to any officers or servants of the said company shall be of anature to require secrecy, it shall and may be lawful for the said board tosend their orders, dispatches, official letters or communications, to the secretcommittee of the said court of directors to be appointed as is by this Actdirected, who shall thereupon without disclosing the same transmit the same accordingto the tenor thereof or pursuant to the directions of the said board to therespective governments and presidencies, officers and servants; and that thesaid governments and presidencies, officers and servants shall be bound topay a faithful obedience thereto, in like manner as if such orders,dispatches, official letters or communications had been sent to them by thesaid court of directors. _________________________ 1. Public Servants (Inquiries) Act, 1850 Section 8

Title: Powers of Commissioners. their Protection. Service of their Process. Powers of Court, Etc., Acting Under Commission

The Commissioners shall have the same power of punishing contempts and obstructions to their proceedings, as is given to Civil and Criminal Courts by 1 [the Code of Criminal Procedure, 1898], and shall have the same powers for the summons of witnesses, and for compelling the production of documents, and for the discharge of their duty under the commission, and shall be entitled to the same protection as the Zila and City Judges, except that all process to cause the attendance of witnesses or other compulsory process, shall be served through and executed by the Zila or City Judge in whose jurisdiction the witness or other person resides, on whom the process is to be served, and if he resides within Calcutta, Madras or Bombay, then through the Supreme Court of Judicature thereto. When the commission has been issued to a Court, or other person or persons having power to issue such process in the exercise of their ordinary authority, they may also use all such power for the purposes of the commission. _____________________________ 1. PUBLIC ACCOUNTANTS' DEFAULT ACT, 1850 Complete Act

.....of any lands belonging6[to such Government].]State Amendments SECTION 04: PROSECUTION OF ACCOUNTANTS AND SURETIES The person or persons at the head of the office to which any public accountant belongs may proceed against any such public accountant and his sureties for any loss or defalcation in his accounts, as if the amount thereof were an arrear of land-revenue due to Government. SECTION 05: ENACTMENTS APPLIED TO PROCEEDINGS BY AND AGAINST ACCOUNTANTS All Regulations and Acts now or hereafter to be in force for the recovery of arrears of land -revenue due to Government, and for recovery of damages by any person wrongfully proceeded against for any such arrears shall apply, with such changes in the forms of procedure as are necessary to make them applicable to the case, to the proceedings against and by such public accountant.
