Coast Guard Act, 1978 Section 12

Title: Certificate of Termination of Service

State: Central

Year: 1978

An enrolled person who retires, or is discharged, released, removed or dismissed from the Coast Guard or permitted to resign therefrom, shall be furnished by the officer, to whose command he is subject, with a certificate in the language which is the mother tongue of such person and also in Hindi or English language setting forth-- (a) the authority terminating his service; (b) the reasons for such termination; and (c) the full period of his service in the Coast Guard.

Sugar Undertakings (Taking over of Management) Act, 1978 Section 11

Title: Power to Terminate the Contract of Employment

If the Custodian or Custodian-General is of opinion that any contract of employment entered into by any owner or member of a notified sugar undertaking or its agent in relation to the said undertaking, at any time before the date of vesting, is unduly onerous, he may, by giving to the employee one month's notice in writing or the salary or wages for one month in lieu thereof, terminate such contract of employment.

THE KERALA GENERAL SALES TAX (AMENDMENT) ACT, 1978 THE KERALA GENERAL SALES TAX (AMENDMENT) ACT, 1978 (ACT 21 OF 1978) An Act further to amend the Kerala General Sales Tax Act, 1963. Preamble." Whereas it is expedient further to amend to Kerala General Sales Tax Act, 1963, for the purposes hereinafter appearing; Be it enacted in the Twenty-ninth Year of the Republic of India as follows:" 1. Short title and commencement."(1) This Act may be called the Kerala General Sales Tax (Amendment) Act, 1978. (2) It shall be deemed to have come into force on the 1st day of April, 1978. 2. Amendment of section 2."In section 2 of the Kerala General Sales Tax Act, 1963 (15 of 1963) (hereinafter referred to as the principal Act)," (1) in clause (viii)," (i) sub-clause (a) shall be omitted; (ii) for sub-clause (e), the following sub-clause shall be substituted, namely:" "(e) a person who, whether in the course of business or not, sells" (i) goods produced by him by manufacture, agriculture, horticulture or otherwise; or (ii) trees which grow spontaneously and which are agreed to be severed before sale or under the contract of sale."; (2) after clause.....

The Meghalaya Transfer of Land (Regulation) (Amendment) Act, 1978 Complete Act

..... (2) It shall have the like extent as the principal Act. (3) It shall come into force at once. Amendment of Section 2 (e) of the principal Act. Act I of 1972. 2. In the Meghalaya Transfer of Land (Regulation) Act, 1971 (referred to in this Act as the principal Act), in Section 2, in clause (e) for the word "and" occurring between the words "Rabhas" and "Kacharis" a comma "(,)" shall be substituted and between the words ˜Kacharis' and "resident" the words "and Koobes" shall be inserted. Amendment of Section 3 of the principal Act. 3. In the principal Act, in Section 3,- (A) For the full-stop "(.)" at the end of subsection (1) a colon "(;)" shall be substituted ; (B) The following proviso to sub-section (1) shall be inserted, namely:- "Provided that the Government of Meghalaya, if satisfied may, from time, by notification, prohibit such transfer of land within such area or areas as may be specified in the notification and thereupon the competent authority shall not sanction any such transfer of land under the provision of this Act, within such area or areas." (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint , SECTION 2: Definitions: In this Act, unless the context otherwise requires,- (a) "Chief Law Officer" and "Law Officer" mean, respectively, the Chief Law Officer and a Law Officer of the Coast Guard appointed under (section 115); (b) "civil offence" means an offence which is triable by a criminal Court. .....and control of the Coast Guard shall vest in, and be exercised by, the Central Government and subject thereto, and to the provision of this Act and the rules, the command and supervision of the Coast Guard shall vest in an officer to be appointed by the Central Government as the Director-General of the Coast Guard. (2) The Director-General shall, in the discharge of his duties under this Act, be assisted by such number of Inspector-General, Deputy Inspector-General, Commandant and such other officers as may be appointed by the Central Government. Section 6 - Enrolment (1) The persons to be enrolled to the Coast Guard, the mode of enrolment and the procedure for enrolment shall be such as may be prescribed. (2) Notwithstanding anything contained in this Act and the rules, every person who has, for a continuous period of three months, been in receipt of pay as a person enrolled under this Act and borne on the rolls of the Coast Guard shall be deemed to have been duly enrolled. Hindustan Tractors Limited (Acquisition and Transfer of Undertakings) Act, 1978 Section 28

Title: Provision Relating to Contracts

.....the appointed day shall remain in force, unless such contract is terminated or modified or altered by the Central Government, the State Government or the Government company, as the case may be, within a period of one hundred and eighty days from the appointed day. (3) The Central Government, the State Government or the Government company, as the case may be, shall not refuse to ratify, terminate, modify or alter a contract under sub-section (1) or sub-section (2) (a) unless it is satisfied that such contract is unduly onerous or has been entered into in bad faith or is detrimental to the interests of the undertakings of the Company; and (b) except after giving to the parties to such contract is reasonable opportunity of being heard and recording in writing its reasons for refusal to ratify the contract or for terminating the contract or for making any alteration or modification therein.

Hindustan Tractors Limited (Acquisition and Transfer of Undertakings) Act, 1978 Complete Act

.....Corporation being the Authorised Controller. The period of the management will expire on the 11th March, 1979. The Company is engaged in the manufacture of agricultural tractors. After the take over of the management of the undertakings of the Company, The production in the Company, which had come to a standstill in November, 1972, has progressively improved. The net losses have come down from the level of Rs. 80 lakhs for the year ending March, 1973 to Rs.9 lakhs for the year ending March, 1977 and during 1977-78 they expect to achieve a nominal net profit of Rs.1 lakh. After careful consideration of the whole matter and with a view to improving the technical and economic viability of the undertakings, the Central Government have decided to acquire the undertakings of the Company and vest them in the State Government of Gujarat. 2. At the time of take over of the management of the undertakings of the Company, it was clear that it was not possible for the Company to meet all its past dues. Accordingly, the Central Government issued an order on the 26th April, 1973, under section 18FB of the Industries (Development and Regulation) Act, 1951, suspending the operation of all the.....

Sugar Undertakings (Taking over of Management) Act, 1978 Complete Act

.....the Ordinance. Gaz. of Ind.. 19-2-1979, Pt. II. S. 2, Ext., p. 3. Amending Act 44 of 1981.- The Sugar Undertakings (Taking Over of Management) Act, 1978 was enacted for enabling the Central Government to take over the management of sugar undertakings for a period not exceeding three years with the object of ensuring the reduction of cane prices arrears and the continued operation of the units. Under the Act. at present eight sugar undertakings are under the management of the Central Government. 2. For achieving the objectives of the Act. Government had to advance loans towards working capital, including payment of cane price dues. to the undertakings taken over under the Act. This has produced good results both in terms of cane crushing and recovery percentage. However, the period of three years for which the management of the undertakings can be retained with the Central Government under the Act has been found to be too short to put the taken over undertakings on a sound footing and to achieve fully the objectives of the Act. In the light of the experience gained in the working of the Act, it is felt that for achieving fully the objectives of the Act it would be necessary.....
