Forward Contracts (Regulation) Act, 1952 Section 13

Title: Power of Central Government to Supersede Governing Body of Recognised Association

State: Central

.....of the governing body which has been superseded; (c) all such property of the recognised association as the person or persons appointed under sub-section (1) may, by order in writing, specify in this behalf as being necessary for the purpose of enabling him or them to carry out the purposes of this Act, shall vest in such person or persons. (3) Notwithstanding anything to the contrary contained in any law or the rules or bye-laws of the association whose governing body is superseded under sub-section (1), the person or persons appointed under that sub-section shall hold office for such period as may be specified in the notification published under that sub-section, and the Central Government may, from time to time, by like notification vary such period. (4) On the determination of the period of office of any person or persons appointed under this section the recognised association shall forthwith reconstitute a governing body in accordance with its rules: Provided that until a governing body is so reconstituted, the person or persons appointed under sub-section. .....of the governing body whichhas been superseded; (c) all such property of the recognised stock exchange as the person orpersons appointed under sub-section(1) may, by order in writing,specify in this behalf as being necessary for the purpose of enabling him orthem to carry on the business of the stock exchange, shall vest in such personor persons. .....Official Gazette supersede the Board for a period of not more than six months: Provided that on the expiration of the period of supersession, the Central Government may reconstitute the Board, in accordance with section 3. (3) Upon the publication of the notification under sub-section (2),-- (a) all the members of the Board shall, notwithstanding that their term of office had not expired as on the date of supersession, vacate their office as such members; (b) all the powers and duties which may, by or under the provisions of this Act, be exercised or performed by or on behalf of the Trust shall, during the period of supersession, be exercised and performed by such person or persons as the Central Government may direct. (4) On the expiration of the period of supersession specified in the notification issued under sub-section (2), the Central Government may-- (a) extend the period of supersession for such further period as it may consider necessary so that the total period of supersession does not exceed more than six months; or (b) reconstitute the Board in the manner provided in section 3.
