Title: Recovery of Sums Due to Government, Board, Market Committee and Others

.....due to the Board or a Market Committee on account of any charge, costs, expenses, fees, rent or on any other account under the provisions of this Act or any rule or bye-law made thereunder or any sum due to an agriculturist for any agricultural produce, specified under sub-section (1) of section 27, sold by him in the market area and which is not paid to him as provided by or under this Act, shall be recoverable from the person from whom such sum is due, in the same manner as if it were an arrear of land revenue. (3) If any question arises whether a sum is due to the Board or Market Committee or any agriculturist within the meaning of sub-section (2), it shall be referred to a Tribunal constituted for the purpose which shall, after making such inquiry as it may deem fit, and after giving to the person from whom it is alleged to be due, an opportunity of being heard, decide the question and the decision of the Tribunal shall be final. (4) The Administrator may constitute one or more Tribunals consisting of one person, possessing such qualifications as may be prescribed who is not connected with the Board or Market Committee or the agriculturist, as the case may be, or with.....

Section 3 - Recovery of certain dues as arrears of land revenue (1) Where any person is party,- (A) to any agreement relating to a loan, advance or grant given to him or relating to credit in respect of, or relating to hire-purchase of goods sold to him by the State Government or the Corporation, by way of financial assistance; or (B) to any agreement relating to a loan, advance or grant to him or relating to credit in respect of or relating to hire-purchase of, goods sold to him by a banking company or a Government company, as the case may be, under a State sponsored scheme; or (C) to any agreement relating to a guarantee given by the State Government or the Corporation in respect of a loan raised by an industrial concern; or (D) to any agreement providing that any money payable thereunder to the State Government shall be recoverable as arrears of land revenue; and such person,- (a) makes any default in payment of the loan or advance or any instalment thereof; or (b) having become liable under the conditions of the grant to refund the grant or any portion thereof, makes any default in the refund of such grant or portion or any.....

Title: Recovery of Sums Due to Market Committee or Board

(1) Any sum due to a market committee or the Board on account of any charge, costs, expenses, fees, rent or on any other account under the provisions of this Act or any rule, regulation or bye-law made thereunder shall be recoverable from the person from whom such sum is due, in the same manner as an arrear of land revenue. (2) If any question arises whether a sum is due to the market committee or the Board within the meaning of sub-section (1), it shall be referred to the1[Director of Agricultural Marketing] or an officer subordinate to him authorised by him, and the1[Director of Agricultural Marketing] or the authorised officer shall after making such enquiry as he deems fit, and after giving to the person from whom the sum is alleged to be due an opportunity of being heard, decide the question; and his decision shall be final and shall not be called in question in any court or before any other authority. _______________ 1. Title: Recovery of Postage and Other Sums Due in Respect of Postal Articles

If any person refuses to pay any postage or other sum due from him under this Act in respect of any postal article, the sum so due may, on application made by an officer of the Post Office authorized in this behalf by the written order of the Post Master General, be recovered for the use of the Post Office from the person so refusing, as if it were a fine imposed under this Act, by any Magistrate having jurisdiction where that person may for the time being be resident; and the Post Master General may further direct that any other postal article, not being on1[Government] service, addressed to that person shall be withheld from him until the sum so due is paid or recovered as aforesaid. _________________________ 1.
