Marriage Laws (Amendment) Act, 2001 Chapter II

Title: Amendments Fo the Indian Divorce Act, 1869

State: Central

In section 36 of the Indian Divorce Act, 1869 (4 of 1869) (hereafter in this Chapter referred to as the Divorce Act), -- (a) For the words "the wife may present a petition for alimony pending the suit", the words "the wife may present a petition for expenses of the proceedings and alimony pending the suit" shall be substituted; (b) For the words "for payment to the wife of alimony pending the suit", the words "for payment to the wife of the expenses of the proceedings nd alimony pending the suit" shall be substituted; (c) After the proviso, the following proviso shall be inserted, namely: -- "Provided further that the petition for the expenses of the proceedings and alimony pending the suit, shall, as far as possible, be disposed of within sixty days of service of such petition on the husband." Section 3 - Amendment of section 41 In section 41 of the Divorce Act, the following proviso shall be inserted, namely: -- "Provided that the application with respect to the maintenance and education of the minor children pending the suit, shall, as far as possible, be disposed of within sixty days from the date of service of notice on the respondent."

.....before the commencement of this Act or filing thereafter, for the prosecution of such agriculturist under section 138 of the Negotiable Instrument Act, 1881 (Central Act 26 of 1881) if the agriculturist files an application in such court raising the contention that the debt is one coming under the purview of this Act. 4. Payment of debt in instalments.--(1) Notwithstanding anything contained in any law or contract or in any decree or order of any court or tribunal, an agriculturist may discharge his debts in the manner specified in sub-section (2) and in sub-section (3). (2) If any debt is repaid in thirty monthly instalments together with interest at the rate specified in section 5, on the principal amount outstanding at the time of each payment, the whole debt shall be deemed to be discharged. (3) The first instalment of any debt payable under sub-section (2) other than a debt payable to a co-operative society shall be paid before the expiry of a period of twelve months from the commencement of this Act and first instalment of any debt due to a co-operative society shall be paid before the expiry of six months from such commencement and each of the remaining instalments.....

(1) Notwithstanding anything contained in sub-section (2) of section 1, all cases pending before the courts or under investigation at the commencement of this Act shall be disposed of in accordance with the provisions of the principal Act as amended by this Act and accordingly, any person found guilty of any offence punishable under the principal Act, as it stood immediately before such commencement, shall be liable for a punishment which is lesser than the punishment for which he is otherwise liable at the date of the commission of such offence: Provided that nothing in this section shall apply to cases pending in appeal. (2) For the removal of doubts, it is hereby declared that no act or omission on the part of any person shall be punishable as an offence which would not have been so punishable if this Act has not come into force.

On the commencement of this Act,- (1) all cases pertaining to matters in respect of which the Controller shall have jurisdiction under this Act and pending in the Court under the Karnataka Rent Control Act, 1961 shall stand transferred to the Controller and the Controller may proceed to hear such cases either de-novo or from the stage it was at the time of such transfer. Protection of Plant Varieties and Farmers-rights Act, 2001 Section 65

Title: Suit for Infringement, Etc.

(1) No suit-(a) for the infringement of a variety registered under this Act; or (b) relating to any right in a variety registered under this Act, shall be instituted in any court inferior to a District Court having jurisdiction to try the suit. (2) For the purposes of clauses (a) and (b) of sub-section (1), "District Court having jurisdiction" shall mean the District Court within the local limits of whose jurisdiction the cause of action arises.

Title: Relief in Suit for Infringement

(1) The relief which a court may grant in any suit for infringement referred to in section 65 includes an injunction and at the option of the plaintiff, either damages or a share of the profits. (2) The order of injunction under sub-section (1) may include an ex pane injunction or any interlocutory order for any of the following matters, namely:-- (a) discovery of documents; (b) preserving of infringing variety or documents or other evidence which are related to the subject-matter of the suit, (c) attachment of such property of the defendant which the court deems necessary to recover damages, costs or other pecuniary remedies which may be finally awarded to the plaintiff.
