Title: Vesting of Management of a Sugar Undertaking in Central Government

.....has in any sugar year failed to commence the manufacture of sugar on or before the appointed day in respect of that year, or having started the manufacture of sugar on or before that day ceased to manufacture sugar before the expiry of the average period of manufacture of sugar in relation to that undertaking; or (b) that on any date in any sugar year any sugar undertaking has, in relation to the cane1[purchased at any time (whether in that sugar year or in any earlier sugar year or sugar years and whether before or after the commencement of this Act), before that date] for the purposes of the undertaking, arrears of cane dues to the extent of more than ten percent, of the total price of the cane purchased for the purposes of the undertaking during the immediately preceding sugar year; and (c) that in either case the effective functioning of the undertaking is necessary for the purposes of this Act, the Central Government may issue a notice in such form and in such manner as may be prescribed to the owner or the manager of such sugar undertaking calling upon such owner or manager to report in writing within such time, not being less than five days, as may be specified in.....

Title: Sugar Development Fund (Amendment) Act, 2008

Amendment of section 4 In the Sugar Development Fund Act, 1982(4 of 1982), in section 4, in sub-section (1), after clause (bbb), the following clause shall be inserted, namely:-- "(bbbb) for defraying expenditure for the purpose of financial assistance to sugar factories towards interest on loans given in terms of any scheme approved by the Central Government from time to time;". 3. Amendment of section 3 In the Sugar Cess Act, 1982(3 of 1982), in section 3, in sub-section (1),-- (a) for the words "fifteen rupees", the words "twenty-five rupees" shall be substituted; (b) the proviso shall be omitted. 4. Repeal and saving (1) The Sugar Development Fund (Amendment) Ordinance, 2008(Ord. 4 of 2008), is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the Sugar Development Fund Act, 1982(4 of 1982) and the Sugar Cess Act, 1982(3 of 1982) as amended bythe said Ordinance, shall be deemed to have been done or taken under the said Acts, as amended by this Act.

.....the Sugar Development Fund (Amendment) Act, 2002. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. 2. Amendment of Act 4 of 1982. In section 4 of the Sugar Development Fund Act, 1982, in sub-section (1),-- (i) after clause (a), the following clauses shall be inserted, namely:-- "(aa) for making loans to any sugar factory or any unit thereof for bagasse-based co-generation power projects with a view to improving their viability; (aaa) for making loans to any sugar factory or any unit thereof for production of anhydrous alcohol or ethanol from alcohol with a view to improving their viability;"; (ii) efter clause (bb), the following clause shall be inserted, namely:-- (bbb) for defraying expenditure on internal transport and freight charges to the sugar factories on export shipments of sugar with a view to promoting its export;".

Title: Relief to Sugar Undertakings and Cane Producing Farmers

.....fit to the Custodian-General and the Custodians to facilitate the speedy clearance of arrears of cane dues so as to avoid undue hardship to cane producing farmers. (2) Without prejudice to the provisions of sub-section (1), the Central Government may render such assistance in such manner as it may deem fit to any notified sugar undertaking to enable the undertaking to clear the whole or any part of its arrears of cane dues so as to avoid undue hardship to cane producing farmers. Explanation. For the purposes of this section, the expression "arrears of cane dues" shall he construed in accordance with the provisions of Cls. (a) and (b) of sub-section (6) of section 3.

Title: Sale by Export Agency of Sugar Delivered

(1) The export agency shall take all practical measures to export sugar delivered to it under this Act: Provided that if the export agency is of opinion that having regard to the quality of the sugar delivered to it by any owner, or to the expenses involved in transporting the sugar from one place to another or to the delay likely to be involved in exporting it, or to the conditions prevailing in the markets for sugar, whether in or out of India or to any other relevant circumstances, it is expedient so to do, the export agency may sell the whole or any part of the sugar in India and may, if it thinks fit, purchase such quantity of sugar as it may consider necessary for export at the appropriate time. (2) For the purposes of sub-section (1), the export agency may itself sell sugar or permit the owner to sell the whole or any part of the export quota in his custody at a price approved by it on condition that the sale proceeds are payable to it.

Title: Payments to Owners in Respect of Sugar Delivered

.....quantity of sugar delivered by them respectively during that year. (3) In making any distribution under this section, the export agency shall make such adjustments as may be necessary having regard to the grade of sugar delivered by any owner, the adjustments being made on the basis of sugar of ISS-E-29 grade and with reference to the price differential schedule for different grades of sugar which the Central Government may, by notification in the Official, Gazette, publish in this behalf. (4) Notwithstanding anything contained in this section and subject to the rules which may be made in this behalf, the export agency may make on account payments to owners against documents of delivery of sugar furnished by them, and such payments shall be adjusted at the time of final payment.
