Title: House Breaking

.....means by which that passage was not intended by the occupier of the house to be opened. Fourthly.--If he enters or quits by opening any lock in order to the committing of the house-trespass, or in order 10 the quitting of the house after a house-trespass. Fifthly.--If he effects his entrance or departure by using criminal force or committing an assault or by threatening any person with assault. Sixthly.--If he enters or quits by any passage which he knows to have been fastened against such entrance or departure, and to have been unfastened by himself or by an abettor of the house-trespass. Explanation.--Any out-house or building occupied with a house, and between which and such house there is an immediate internal communication, is part of the house within the meaning of this section. Illustrations (a) A commits house-trespass by making a hole through the wall of Z's house, and putting his hand through the aperture. This is house-breaking. (b) A commits house-trespass by creeping into a ship at a port-hole between decks. This is house-breaking. (c) A commits house-trespass by entering Z's house through a window. This is house-breaking. Section 89 - Stores to be free of export duty Goods produced or manufactured in India and required as stores on any foreign-going vessel or aircraft may be exported free of duty in such quantities as the proper officer may determine, having regard to the size of the vessel or aircraft, the number of passengers and crew and the length of the voyage or journey on which the vessel or aircraft is about to depart. Section 90 - Concessions in respect of imported stores for the Navy (1) Imported stores specified in sub-section (3) may without payment of duty be consumed on board a ship of the Indian Navy. (2) The provisions of section 69 and Chapter X shall apply to stores specified in sub-section (3) as they apply to other goods, subject to the modification that- (a) for the words "exported to any place outside India", or the word "exported" wherever they occur1 , the words "taken on board a ship of the Indian Navy" shall be substituted; (b) for the words "ninety-eight per cent" in sub-section (1) of section 74, the words "the whole" shall be substituted. In the Town of Calcutta and its environs and in any other town or place to which the provisions of this Act may hereafter be extended, by a law to be passed for that purpose the Oriental Gas Company Limited under such superintendence as is hereinafter specified may open and break up the soil and pavement of the several streets and bridges and may open and break up any sewers drains or tunnels within or under such streets and bridges and lay down and place within the same limits pipes conduits service pipes and other works and from time repair alter or remove the same and also make any sewers that may be necessary for carrying off the washings and waste liquids which may arise in the making of the Gas and for the purposes aforesaid may remove and use all earth and materials inland under such streets and bridges and they may in such streets erect any pillars lamps and other works and do all other acts which the said Company shall from time to time deem necessary for supplying Gas to the inhabitants of the said Town of Calcutta and its environs or other town or place as aforesaid doing as title damage as may be in the execution of the powers hereby granted and making compensation.....

Before the said Company proceed to open or break up any street, bridges, sewer, drain.or tunnel shall given to the municipal Commissioners for the Town of Calcutta, or Other persons under whose control or management the same may be or to other persons under whose control to management the same may be or to their Clerk, Surveyor, or other officer notice in writing of their intention or open or break up the clear days before beginning such work ; except in cases of emergency arising from defects in any of the pipes or other works, and then so soon as is possible after the beginning of the work or the necessity for the same shall have arisen.
