Amendment of section 2 In the Electricity Regulatory Commissions Act, 1998 (14 of 1998) (hereinafter referred to as the principal Act), in section 2, -- (a) In clause (c), for the words or the State Commission, the words or the State Commission or the Joint Electricity Regulatory Commission shall be substituted; (b) After clause (e), the following clause shall be inserted, namely: -- (ea) Joint Electricity Regulatory Commission means the Joint Electricity Regulatory Commission constituted under section 21A; 3.Insertion of new Chapter IVA After Chapter IV of the principal Act, the following Chapter shall be inserted, namely: -- CHAPTER IVA JOINT ELECTRICITY REGULATORY COMMISSION 21A......

.....under the Urban Land(Ceiling and Regulation) Act, 1976 has held that the Mysore Palace andsurrounding land came within the regulation of the said Act and has passed anorder declaring substantial portion of the land surrounding the Mysore Palaceas surplus land to be surrendered to the State Government and the said order isupheld in appeal before the Karnataka Appellate Tribunal; WHEREAS, the legal representatives and heirs of lateJayachamarajendra Wadeyar have in some writ petitions questioned the legalityof the order passed by the Appellate Authority and these writ petitions arepending before the High Court of Karnataka; WHEREAS, the legal representatives and heirs of lateJayachamarajendra Wadeyar had in their letters dated 18.8.75, 3.9.75, 7.2.76and 10.2.76 requested the State Government to take over the possession of thePalace other than the portion of the palace in which they are residing andaccordingly the State Government took possession of the portion of palace atMysore with movables by issuing a Government Order No.GAD 2 PSR 76, dated26.2.76 and has thereafter spent considerable amounts for maintenance of thePalace as a Public monument and for preserving its public.....

I/We further declare that no transaction for which an exemption is claimed under Article 5 or Article 36 in Schedule to the Rajasthan Stamp Act, 1998, as the case may be, is omitted." .....in the generation, transmission, sale, distribution or supply, as the case may be, of energy; (m) words and expressions used and not defined in this Act but defined in the Electricity (Supply) Act, 1948 (54 of 1948)-or the Indian Electricity Act, 1910 (9 of 1910)-shall have the meanings respectively assigned to them in those Acts. SECTION 03: ESTABLISHMENT AND INCORPORATION OF CENTRAL COMMISSION (1) The Central Government shall, within three months from the date of the commencement of this Act by notification in the Official Gazette, establish a body to be known as the Central Electricity Regulatory Commission to exercise the powers conferred on, and the functions assigned to, it under this Act. (2) The Central Commission shall be a body corporate by the name aforesaid, having perpetual succession and a common seal with power to acquire, hold and dispose of property, both movable and immovable, and to contract and shall, by the said name, sue or be sued. (3) The head office of the Central Commission shall be at such place as the Central Government may, by notification in the Official Gazette, specify. (7) Notwithstanding anything contained in sub-section (5) or sub-section (6), the State Government may appoint any person as the Chairperson from amongst persons who is or has been a Judge of a High Court: Provided that no appointment under this sub-section shall be made except after consultation with the Chief Justice of that High Court. (8) The Chairperson shall be the Chief Executive of the State Commission. (9) The Chairperson or any other Member of the State Commission shall not hold any other office. Title: Constitution of Selection Committee by State Government

(1) The State Government shall, for the purposes of selecting the Members of the State Electricity Commission, constitute a Selection Committee consisting of-- (a) a person who has been a Judge of the High Court --Chairperson; (b) the Chief Secretary of the concerned State --Member; (c) the Chairperson or a Member of the Central Electricity Authority --Member: Provided that nothing contained in this clause shall apply to the appointment of a person as the Chairperson who is or has been a Judge of the High Court. (2) No appointment of a Member shall be invalid merely by reason of any vacancy in the Selection Committee. (3) The State Government shall, within one month from the date of occurrence of any vacancy by reason of death, resignation or removal and six months before the superannuation or end of tenure of any Chairperson or a Member, make a reference to the Selection Committee for filling up of the vacancy. (4) The Selection Committee shall finalise the selection of the Member, within one month from the date on which the reference is made to it. (5) The Selection Committee shall recommend a pa
