Be it enacted by the Chhattisgarh Legislative Assembly in the Fifty-fourth year of the Republic of India as follows :-- Section 1 - Short title and Commencement (1) This Act may be called the Chhattisgarh Special Police Establishment (Repeal) Act, 2003. (2) It shall come into force from the date of its publication in the Gazette. Section 2 - Repeal and Savings (1) The Chhattisgarh Special Police Establishment Act, 1947 (No. 17 of 1947) is hereby repealed and the Special Police Establishment created under the said Act is dissolved. (2) All assets and liabilities of the aforesaid Special Police Establishment shall be vested in the State Government which shall have powers to take possession of, recover and otherwise deal with such assets and discharge such liabilities; (3) The State Government may be order entrust matters pending in the aforesaid Special Police Establishment to any other organization which shall deal with such matters there after : Provided that those matters referred to the aforesaid Special Police Establishment before its dissolution by the Chhattisgarh Lok Aayog shall stand transferred to the agency appointed by the.....

In this Act, unless the context otherwise requires,-- (a) "Appellate Authority" means the Appellate Authority for Industrial and Financial Reconstruction constituted under section 5 of the Sick Industrial Companies (Special Provisions) Act, 1985(1 of 1986); (b) "Board" means the Board for Industrial and Financial Reconstruction established under section 4 of the Sick Industrial Companies (Special Provisions) Act, 1985(1 of 1986); (c) words and expressions used herein and not defined but defined in the Sick Industrial Companies (Special Provisions) Act, 1985(1 of 1986), shall have the meanings respectively assigned to them in that Act.

Title: Amendment of Section 4

In the Special Protection Group Act, 1988(34 of 1988) (hereinafter referred to as the prinicpal Act), in sub-section (1) of section 4, for clause (ii), the following clause shall be substituted, namely:-- "(ii) any former Prime Minister or to the members of his immediate family-- (a) for a period of one year from the date on which the former Prime Minister ceased to hold office and beyond one year based on the level of threat as decided by the Central Government, so however that not more than twelve months shall elapse between two consecutive assessments made in regard to the need for proximate security: Provided that while deciding the level of threat, the Central Government shall take into account, among other things, the following factors, namely:-- (A) that the threat emanates from any militant or terrorist organisation or any other source; and (B) that the threat is of a grave and continuing nature; (b) on their visits abroad, based on entitlement to proximate security and the level of threat as assessed by the Central Government;".
