National Biodiversity Authority to bebound by the directions given by Central Government.-- (1) Without prejudice to theforegoing provisions of this Act, the National Biodiversity Authority shall, in the discharge of itsfunctions and duties under this Act, be bound by such directions on questionsof policy as the Central Government may give in writing to it from time totime: Provided that the NationalBiodiversity Authority shall, asfar as practicable, be given opportunity to express its views before anydirection is given under this sub-section. PREVENTION OF MONEY LAUNDERING ACT, 2002 PREVENTION OF MONEY LAUNDERING ACT, 2002 An Act to prevent money-laundering and to provide for confiscation of property derived from, or involved in, money-laundering and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Fifty-third Year of the Republic of India as follows:- CHAPTER 01 PRELIMINARY SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Prevention of Money Laundering Act, 2002. (2) It extends to the whole of India. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Act and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. SECTION 02: DEFINITIONS (1) In this Act, unless the context otherwise requires, - (a) "Adjudicating Authority" means an Adjudicating Authority appointed under sub -section (1) of section 6 -; (b) "Appellate Tribunal" means the Appellate Tribunal established under section 25-; (c) "Assistant.....

Title: Power Regarding Summons, Production of Documents and Evidence, Etc

(1) The Adjudicating Authority shall, for the purposes of this Act, have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908 (5 of 1908) while trying a suit in respect of the following matters, namely:-- (a) discovery and inspection; (b) enforcing the attendance of any person, including any officer of a banking company or a financial institution or a company, and examining him on oath; (c) compelling the production of records; (d) receiving evidence on affidavits; (e) issuing commissions for examination of witnesses and documents; and (f) any other matter which may be prescribed. (2) All the persons so summoned shall be bound to attend in person or through authorised agents, as the Adjudicating Authority may direct, and shall be bound to state the truth upon any subject respecting which they are examined or make statements, and produce such documents as may be required. (3) Every proceeding under this section shall be deemed to be a judicial proceeding within the meaning of section 193 and section 228 of the Indian Penal Code.

Prevention of Money-laundering Act, 2002 Section 50

Title: Powers of Authorities Regarding Summons, Production of Documents and to Give Evidence, Etc

.....shall be bound to attend in person or through authorised agents, as such officer may direct, and shall be bound to state the truth upon any subject respecting which they are examined or make statements, and produce such documents as may be required. (4) Every proceeding under sub-sections (2) and (3) shall be deemed to be a judicial proceeding within the meaning of section 193 and section 228 of the Indian Penal Code. (5) Subject to any rules made in this behalf by the Central Government, any officer referred to in sub-section (2) may impound and retain in his custody for such period, as he thinks fit, any records produced before him in any proceedings under this Act: Provided that an Assistant Director or a Deputy Director shall not-- (a) impound any records without recording his reasons for so doing; or (b) retain in his custody any such records for a period exceeding three months, without obtaining the previous approval of the Director.

Prevention of Money-laundering Act, 2002 Chapter III

Title: Attachment, Adjudication and Confiscation

.....sub-section (1) shall cease to have effect after the expiry of the period specified in that sub-section or on the date of an order made under sub-section (2) of section 8, whichever is earlier. (4) Nothing in this section shall prevent the person interested in the enjoyment of the immovable property attached under sub-section (1) from such enjoyment. Explanation.--For the purposes of this sub-section, "person interested", in relation to any immovable property, includes all persons claiming or entitled to claim any interest in the property. (5) The Director or any other officer who provisionally attaches any property under sub-section (1) shall, within a period of thirty days from such attachment, file a complaint stating the facts of such attachment before the Adjudicating Authority. ______________________ 1.
