Title: Recovery of Service Tax Not Levied or Paid or Short Lived or Short-paid or Erroneously Refunded

.....but for this sub-section. 4[Explanation 2.--For the removal of doubts, it is hereby declared that no penalty under any of the provisions of this Act or the rules made thereunder shall be imposed in respect of payment of service-tax under this sub-section and interest thereon.] (4) Nothing contained in sub-section (3) shall apply to a case where any service tax has not been levied or paid or has been short-levied or short-paid or erroneously refunded by reason of-- (a) fraud; or (b) collusion; or (c) wilful misstatement; or (d) suppression of facts; or (e) contravention of any of the provisions of this Chapter or of the rules made thereunder with intent to evade payment of service tax. (5) The provisions of sub-section (3) shall not apply to any case where the service tax had become payable or ought to have been paid before the 14th day of May, 2003. (6) For the purposes of this section, "relevant date" means,-- (i) in the case of taxable service in respect of which service tax has not been levied or paid or has been short-levied or short-paid-- (a) where under the rules made under this Chapter, a periodical return, showing particulars of service tax paid.....

Amendment of section 3.-- In section 3 of the principal Act, for sub-section (2), the following sub-section shall be substituted, namely:-- "(2) A notification issued under sub-section CO or under section 3A shall operate as if it has been issued under section 11 of the Customs Act, 1962 (52 of 1962) and the officers of the customs at every port, airport, Inland Container Depot and Land Customs Station shall have the same powers in respect of any live-stock or livestock product or thing with regard to the importation of which such a notification has been issued and the vessel, aircraft, vehicle and other mode of conveyance containing the same, as they have for the time being in respect of any article the importation of which is regulated, restricted or prohibited by the law relating to customs and the vessel, aircraft, vehicle and other mode of conveyance containing the same; and the enactments for the time being in force relating to customs or any such article or vessel, aircraft, vehicle and other mode of conveyance shall apply accordingly,". 5. THE LIVE-STOCK IMPORTATION (AMENDMENT) ACT, 1953 [Act, No. 40 of 1953] [16th December, 1953] PREAMBLE An Act further to amend the Live-Stock Importation Act, 1898. BE it enacted by Parliament as follows-- 1. Short title.-- This Act may be called the Live-stock Importation (Amendment) Act, 1953. 2. Amendment of section 1, Act IX of 1898.-- In section 1 of the Live-stock Importation Act, 1898 (hereinafter referred to as the principal Act), for sub-section (2), the following sub-section shall be substituted, namely:-- "(2) It extends to the whole of India except the State of Jammu and Kashmir.". 3. Amendment of section 2, Act IX of 1898.-- In this section 2 of the principal Act, after clause (b), the following clause shall be inserted, namely:-- "(c) 'import' means the bringing or taking, by sea, land or air, into the territories to which this Act extends.". 4. Amendment of section 3, Act IX of 1898.-- In section 3 of the principal Act, in sub-section(1), for the words "the bringing or taking, by sea or land", the words "the import" shall be substituted.

.....of opinion that such bull has attained the prescribed age or is suffering from any of the defects or disease specified in section 7, direct that the said bull shall be - (a) castrated in the prescribed manner, and (b) sold by public auction or sent to a pinjrapol : provided that, if the owner of the said bull appears within fifteen days of such seizure and proves to the satisfaction of the live-stock officer that the said bull is of his ownership,- the said bull - (i) if not sold by public auction, or (ii) if sent to a pinjrapol, shall be delivered to such owner on payment of the costs, charges and expenses incurred for the maintenance of the said bull and determined in the prescribed manner, or (iii) if sold by public auction, the proceeds of such sale shall be paid to such owner after deducting therefrom the costs, charges, and expenses incurred for the maintenance and sale of the said bull and determined in the prescribed manner.
