THE ASSAM (TEMPORARILY SETTLED AREAS) TENANCY ACT, 1971 THE ASSAM (TEMPORARILY SETTLED AREAS) TENANCY ACT, 1971 [Act XXIII of 1971] [10th December, 1971] PREAMBLE An Act to regulate the relations of landlord and tenant in the temporarily settled areas of Assam. Whereas it is expedient to regulate to the rights and liabilities of agricultural tenants and their landlords in temporarily settled lands in the State of Assam; It is hereby enacted in the twenty-second year of the Republic of India as follows" ___________________________ Received the assent of the President on the 3rd December, 1971. Published in the Assam Gazette, Extraordinary, dated the 10th December, 1971. Section 1 - Short title, extent and commencement (1) This Act may be called the Assam (Temporarily Settled Areas) Tenancy Act, 1971. (2) It shall come into force at once (With effect from 10th December 1971). .....the Collector shall thereupon proceed to value and make compensation for such huts, trees and crops, in the manner prescribed in Section 12 of this Act. Section 8 - Section 8 Clause 1. Application by land-holder to have a sluice made in public embankment - If any land-holder, farmer or cultivator be desirous of having a sluice made in any public embankment for the purpose of drainage or irrigation, he shall make an application in writing to the Collector of the district in which such embankment is situate. The application shall contain such particulars of the land to be drained or irrigated as may enable the officers of the Crown to judge of the advantage which may be derived from the work, and shall declare as regards an embankment maintained at the expense of the State, whether the applicant is willing to bear such part, not exceeding half of the cost thereof, as may be determined by the Provincial Government; and, as regards any other public embankment whether the applicant is willing to defray the whole or such part of the cost incidental to and attendant on, the proposed work, as may be determined as aforesaid. .....to the provisions of sub-section (1), every person who had acquired a document, purporting to be a share, bona fide for value without notice of the fact that it did not represent any contribution to the capital of the old company, shall be entitled to claim reimbursement from the person from whom such document was acquired by him, and, the period of limitation for any action for such reimbursement shall be deemed, to commence on the date on which the document held by him as a share stands cancelled under section 15. Section 17 - Power of Tribunal to entertain and dispose of claims for reimbursement (1) The Tribunal shall have jurisdiction to entertain and dispose of any claim for reimbursement referred to in sub-section (2) of section 16. (2) Every such claim shall be made before the Tribunal within thirty days from the date on which the document purporting to be a share stands cancelled under section 15. Section 18 - Suits and legal proceedings, not to be commenced or proceeded with (1) On and from the date on which the Tribunal is constituted, no suit or other legal proceeding shall be commenced, or if pending at the date of such constitution, shall be proceeded.....

1[(1) Notwithstanding anything contained in section 5A, every1 [proprietor or stockist] liable to pay tax under this Act shall furnish to the assessing authority within sixty days of the expiry of the year, a return in the prescribed from. (2) Before any2 [proprietor or stockist] submits any return under sub-section (1), he shall in the prescribed manner, pay in advance the full amount of tax payable by him on the basis of such return as reduced by any tax already paid under section5-A and shall furnish along with the return satisfactory proof of the payment of such tax, and a return without such proof of payment shall not be deemed to have been filed. After the final assessment is made, the amount of tax so paid shall be deemed to have been paid towards the tax finally assessed.
