Title: Regulation of Recruitment and the Conditions of Service

.....by the Chief Justice under clause (2) of article 229 of the Constitution of India regulating the conditions of service of the officers and servants of the High Court of Karnataka; and (iii) made by the Governor under the proviso to article 309 of the Constitution of India, regulating the recruitment and conditions of service of persons appointed to the civil services and posts in connection with the affairs of the State ; and (iv) made by the Government under any law for the time being in force, shall be deemed to be rules made under sub-section (1) and shall continue in force until they are modified or replaced by rules made under this Act. __________________________ 1. .....to regulate the recruitment and the conditions of service of persons appointed to Civil Services of the State of Karnataka and posts in connection with the affairs of the State of Karnataka. WHEREAS under clause (2) of Article 187, clause (2) of Article 229 and Article 309 of, and under entries 3 and 41 of List II of the Seventh Schedule to, the Constitution of India, the Legislature of the State may by law regulate the recruitment and the conditions of service of persons appointed to public services and posts in connection with the affairs of the State of Karnataka and to the Secretariat staff of the Houses of the Karnataka State Legislature; and the conditions of service of officers and servants of the High Court of Karnataka; AND whereas it is expedient to make a law for the aforesaid matters and for other matters hereinafter appearing ; BE it enacted by the Karnataka State Legislature in the Twenty-ninth Year of the Republic of India as follows :- ________________________ 1. Banking Service Commission (Repeal) Act, 1978 Complete Act

SECTION 05: SAVINGS (1) Anything done or any action taken under the Banking Service Commission (Repeal) Ordinance, 1977, which ceased to operate, shall be deemed to have been done or taken under the corresponding provisions of this Act. (2) Nothing in this Act shall be deemed to affect the right of the Chairman of the Banking Service Commission or of any other person appointed by the said Commission to receive salary, allowances or other benefits, in accordance with the terms and conditions of service applicable to him. for the period from the date of cesser of operation of the said Ordinance till the date on which this Act receives the assent of the President (both days inclusive). Section 4 - Reservation for Scheduled Castes and Scheduled Tribes in vacancies to be filled by direct recruitments At the commencement of this Act, all appointments to services and posts in the establishment which are to be filled up by direct recruitment shall be regulated in the following manner, namely- (a) subject to the other provisions of this Act, seven percent of the vacancies shall be reserved for the candidates belonging to Scheduled Castes and ten percent for Scheduled Tribes (Plains) and five percent for Scheduled Tribes (Hills), in the manner set out in the Schedule : Provided that the State Government may from time to time review the implementation of the reservation policy and take adequate measures including increase of percentage, mentioned.....

[31st March, 1978} WHEREAS it is expedient to make provisions for the maintenance of certain essential services and the normal life of the community.
