Title: Power for State Government to Require Master or Engineer to Hold Certificate Granted Under Act in Addition to Other Certificate

.....the Merchant Shipping Act, 1958], or (b) an engineer's or engine-driver's2[certificate granted or deemed to be granted under the Merchant Shipping Act, 1958], shall not act as master or engineer, as the case may be, of an inland3[mechanically propelled vessel] unless he also possesses-- (i) in case (a), such a master's or sering's certificate granted under this Act as qualifies him under this Chapter to act as master of the3[mechanically propelled vessel], or (ii) in case (b), such an engineer's or engine-driver's certificate granted under this Act as qualifies him under this Chapter to act as engineer of the3[mechanically propelled vessel]: Provided that, for the purposes of this section, the State Government may4[if it thinks fit], grant to any person, without examination, a master's or scrang's or an engineer's or engine-driver's certificate of competency under this Act, and such certificate shall have the same effect as a certificate of competency granted under this Act after examination. ________________________ 1. .....several provinces was as follows: In 1875 a Fisheries Act was passed for British (now lower) Burma. In 1880 the Punjab Government submitted a draft Act and Rules. In 1881 the Bombay Government submitted a Bill for the preservation of game and fish. In 1883, the Government of Madras submitted a draft Fishery Bill. In 1889 the North-Western Provinces Government submitted recommendations made hy the Commissioner of Kumaon for preserving fish in the hills. The conference at Delhi was unanimous in making the following five recommendations: (1) The prevention of dynamite and other explosives being used for the destruction of fish: (2) The prevention of poisoning waters: (3) The enforcement of fish ladders on weirs and other works in rivers of any size. ten vards width being suggested as a minimum; (4) The regulation of fixed obstructions and engines in such rivers; (5) The protection of stock-pools. The members of the Conference differed as to the expediency of (a) regulating the size of the mesh of nets; (h) prohibiting or regulating the haling out rivers and streams for the purpose of catching fish; and (c) conferring on the Government power to assume control of the right to fish in.....

..... 1. Short title:- These rules may be called the requisitioning and acquisition of immovable property rules, 1953. 2. Definitions:- In these Rules (a) Act means the Requisitioning and Acquisition of immovable property Act, 1952. [(aa) "Court" means a principal court of original jurisdiction in the district in which the property requisitioned or acquired is situated.] (b) "Form" means a form appended to these rules. (c) "Section" and "Sub-section" mean respectively a section or sub-section of the Act. 3. Procedure to be followed by competent Authority for purposes of section 3 - (1):- a notice under clause (a) if sub-section(1) and order under clause (b) of sub-section (1) of section 3 of the Act shall be in form ˜A'. 4. Order of Requisitioning:- The order of requisition under sub-section (2) of section 3 of the Act and the notice under sub-section 4 of the Act shall be issued in form ˜E'. 5. Breaking open of locks on requisitioned property: - Where the possession of a requisitioned property is not handed over in compliance with an order issued under sub-section(1) of section 4 of the Act and the premises are found locked, the competent authority.....
