.....to Union pensions and State pensions. In so far as State pensions are concerned. State Legislatures alone have competence to make amendment to the Act. 2. The Act does not extend to the territories which immediately before the 1st November, 1956 were comprised in Part B States. Hence pensioners in these territories cannot avail of the protection provided in section 11 of the Act against seizure, attachment or sequestration by process of any Court at the instance of a creditor. It is, therefore, proposed to amend section 1 of the Act so that the provisions of the Act, in so far as they relate to Union pensions, extend to the whole of India, 3. In view of section 12 of the Act, .at present it is not possible for a pensioner to nominate someone, who may receive payment of arrears of pension remaining undrawn at the time of the death of the pensioner. It has been represented that in the absence of a provision enabling the making of such nominations, the heirs of deceased pensioners are put to undue hardship as they have to obtain succession certificates for the purpose of claiming such arrears. Whereas it is expedient to establish and constitute a Central Pension and Provident Fund for the employees of the Non-Government Deficit Colleges in Assam to make provisions for payment of pension and other retirement benefits to the employees of the said Colleges. It is hereby enacted in the Forty-eighth year of the Republic of India as follows- STATEMENT OF OBJECT AND REASONS The Non-Government (Deficit) Colleges in Assam have been established from time to time due to demand of the situation. Such attachments involve Government in some avoidable litigation. It is unfair that whereas the estate is protected from attachment, the price of that estate, when it is compulsorily acquired for a public purpose, should have no such protection. This Bill is intended to exempt the compensation awarded under the Land Acquisition Act, from attachment. (vide Punjab Government Gazette Extraordinary, dated the 6th March, 1948, Page 179). 1. Short title: - This Act may be called The Land Acquisition (East Punjab Amendment) Act, 1948. 2. Insertion of section 52-A in Act 1 of 1894. " After section 52 of Land Acquisition Act, 1894, the following section shall be deemed to be inserted, namely: - 52-A. Protection of compensation: - No compensation awarded or awardable under this Act: - (a) Before its actually paid to the person entitled to receive the same; or (b) Before it is actually paid to the person entitled to receive the same in respect of any land which is not liable under the law for the time being.....
