West Bengal Local Authorities (Postponement of Elections) Repealing Act, 1963 Complete Act

.....(Postponement of Elections) Act, 1963 (hereinafter referred to as the said Act), is hereby repealed. (2) Subject to the provisions of section 3, such repeal shall not affect any thing, action, right, privilege, obligation or liability done, taken, acquired, accrued or incurred or suffered to be done, taken, acquired, accrued or incurred under the said Act. Section 3 Validity of certain steps taken It is hereby declared that anything done or any action taken for or in connection with the holding of an election or any election held after the commencement of the said Act and before the coming into operation of this Act shall, notwithstanding anything contained in the said Act, be deemed to have been as validly done, taken or held, as the case may be, as if this Act had been in operation when such thing was done, such action was taken or such election was held. Explanation. In this section "election" has the same meaning as in the said Act. West Bengal State Acts

.....01: SHORT TITLE This Act may be called the Maharashtra Local Authorities (Postponement of Election for the Duration of the Emergency (Repeal) Act, 1963 SECTION 02: REPEAL OF MAH. XXXIX OF 1962 AND SAVINGS The Maharashtra Local Authorities (Postponement of Elections for the Duration of the Emergency) Act. 1962 is hereby repealed Provided that, notwithstanding the repeal of the said Act, and notwithstanding anything in any enactment by or under which any local authority is constituted or established. (a)the term of office of the Councilors or members extended by section 3 of the act now repealed and of councilors and members nominated under clause(a), or of any officer appointed under clause (b) of section 4 of the said Act, shall expire on the 31st day of December, 1963; but the councilors of members or as the case may be, the officer, shall continue in office until the first meeting of the local authority duly constituted under the relevant Act, at which a quorum is present; (b) the delegation of any powers duties and functions to any officer under Section 5 of the Act now repealed, shall continue to have effect until the expiration of the term of appointment of the.....

Title: Power of Central Government to Extend Time for Election or Appoint Trustees in Default of Election

(1) If the Central Government is satisfied that an electing body has failed to elect a Trustee within the period specified therefor in sub-section (4) of Section 3 or Section 10 for reasons beyond its control, the Central Government may, by notification in the Official Gazette, direct that the election shall be held on or before such date as may be specified in the notification. (2) In the event of default being made in electing any Trustee within the period specified therefor under sub-section (4) of Section 3 or under Section 10, or as the case may be, on or before the date specified in the notification issued under sub-section (1), it shall be lawful for the Central Government to appoint a person by notification in the Official Gazette and the person so appointed shall be deemed to be an elective Trustee.

Title: Provisions for Election to Parliament from Goa, Daman and Diu, and Pondicherry

(1) As soon as practicable after the commencement of this Act, elections shall be held in accordance with law- (a) to fill the seats in the House of the People allotted to the Union territory of Goa, Daman and Diu; and (b) to fill the seat in the House of the People and the seat in the Council of States allotted to the Union territory of Pondicherry. (2) Notwithstanding anything contained in any other law for the time being in force, the members nominated to represent the Union territory of Goa, Daman and Diu in the House of the People shall continue to be such until the election of the members to fill the two seats in that House allotted to that Union territory: Provided that where the dates of election of the members are different, the members so nominated shall cease to be members of that House on the earlier of those two dates. Explanation.- In this sub-section, the expression "date of election" has the same meaning as in Section 67-A of the Representation of the People Act, 1951-.

Title: Defects in Appointments or Election Not to Invalidate Acts, Etc

No act or proceeding of a Board or of any of its committees shall be invalid merely by reason of-- (a) any vacancy therein or any defect in the constitution thereof, or (b) any defect in the election or appointment of a person as a member thereof, or (c) any Trustee having acted or taken part in any proceedings in contravention of section 19, or (d) any irregularity in its procedure not affecting merits of the case.
