B E it enacted by the Legislature of the State of Orissa in the Forty-third Year of the Republic of India as follows:- Short title and commencement. 1 . (1) This Act may be called the Orissa Municipal Councils (Postponement of Elections) Amendment Act, 1992. Amendment of section 3. Orissa Act 15 of 1991. 2 . .....Municipal Act. Postponement of General Elections in Municipal Councils. 3 . Notwithstanding anything contained in the Municipal Act or in any rules or orders made or issued thereunder:- (a) all proceedings or actions, excepting those actions taken for delimitation of wards and reservation of seats for members of Scheduled Castes and Scheduled Tribes, taken in furtherance of holding general elections for the reconstitution of the Municipal Councils specified in the Schedule are hereby cancelled; and (d) The general elections for the reconstitution of the said Municipal Councils shall be held in accordance with the provisions of the Municipal Act and the rule made thereunder on such date not being later than the 30th June, 1984, (except for the Bhubaneswar Municipal Council)[Inserted by Orissa Act 21 of 1984, s. 2.] which shall be held not later than (the 31st December, 1988),[Substituted by the Orissa Municipal Councils (Postponement of Elections) Amendment Act 1988 (Orissa Act 6 of 1988) s. 2.] as may be fixed by the State Government and the election so held shall, for all purposes, be deemed to be a general election held under that Act. .....be exercised and discharged by the Grama Panhayat Extension Officer having jurisdiction over the concerned Grama or by any other officer authorised by the State Government in that behalf. (2) The general election as referred to in clause (a) of sub-section (1) of members (including Sarpanch) shall be held in accordance with the provisions of the Grama Panhayats Act and the Rules made thereunder. (3) The Grama Panchayats so reconstituted shall, for all intents and purposes, be deemed to have been constituted under, and be governed by, the provisions of the Grama Panchayats Act and the rules made thereunder.
