EMPLOYEES' STATE INSURANCE ACT, 1948 Section 52

Title: Dependant's benefit

1[(1) If an insured person dies as a result of an employment injury sustained as an employee under this Act (whether or not he was in receipt of any periodical payment for temporary disablement in respect of the injury) dependant's benefit shall be payable 2[at such rates and for such period and subject to such conditions as may be prescribed by the Central Government] to his dependants specified in 3[sub-clause (i), sub-clause (ia) and] sub-clause (ii) of clause (6A) of section 2. (2) In case the insured person dies without leaving behind him the dependants as aforesaid, the dependants' benefit shall be paid to the other dependants of the deceased 2[at such rates and for such period and subject to such conditions as may be prescribed by the Central Government]. _______________ 1. (1) Any decision awarding dependants' benefit under this Act may be reviewed at any time by the Corporation if it is satisfied by fresh evidence that the decision was given in consequence of non-disclosure or misrepresentation by the claimant or any other person of a material fact (whether the non-disclosure or misrepresentation was or was not fraudulent) or that the decision is no longer in accordance with this Act due to any birth or death or due to the marriage, re-marriage or cesser of infirmity of, or attainment of the age of eighteen years by, a claimant. (2) Subject to the provisions of this Act, the Corporation may, on such review as aforesaid, direct that the dependants' benefit be continued, increased, reduced or discontinued.]

No traversing part of a self-acting machine in any factory and no material carried thereon shall, if the space over which it runs is a space over which any person is liable to pass, whether in the course of hi s employment or otherwise, be allowed to run on its outward or inward traverse within a distance of1[forty-five centimetres] from any fixed structure which is not part of the machine: Provided that the Chief Inspector may permit the continued use of a machine installed before the commencement of this Act which does not comply with the requirements of this section on such conditions for ensuring safety as he may think fit to impose. ___________________ 1. .....Judicial Officer and labelling it as a juvenile court does not serve the requirement of the Statute. The Statutory Scheme contemplates a Judicial Officer of a different type with more sensitive approach oriented outlook. (F) The problem child, though negative factor, is a social responsibility. The society must devote full attention to ensure that children are properly cared for and brought up in a proper atmosphere where they could receive adequate training, education and guidance. (G) The Children's Aid Society, within the meaning of Article 12, is undoubtedly an instrumentality of the State. The Society has to regulate its activities not only in accordance with the statutory requirements but also act in a manner satisfying the requirements of the constitutional provisions of Articles 21 and 24 as also the directive principles of the State policy.-Sheela Barse v.
