.....assent of the Governor on 13th day of December , 2000 is hereby published for general information:- THE SIKKIM CEILING ON GOVERNMENT GUARANTEES ACT, 2000 (ACT NO. 21 OF 2000) An Act To provide ceiling on Government Guarantees and other matters connected therewith. Be it enacted by the Legislature of Sikkim in the fifty-first year of the Republic of India as follows:- Short title and Commencement. 1. (1) This Act may be called the Sikkim Ceiling on Government Guarantees Act, 2000. Definitions. 2. (2) It shall come into force at once. In this Act, Unless the context otherwise requires:- (a) ˜Default risk' means the probability of default by the borrower on whose behalf the Government Guarantee is given, depending on the amount borrowed, the type of industry and the economic situation . (b) "Government " means the State Government of Sikkim. (c) "government Guarantee" includes the guarantee given by the State Government on behalf of Departmental Undertakings, Public Sector Undertakings, Local Authorities , Statutory Boards and Corporations and Co-operative-Institutions. .....Sikkim Public Premises (Eviction of Unauthorised Occupants and Rent Recovery) Act, 1988. Amendment of section 4 4. In section 4 of the principal Act, in sub-section (1) (a) for the words "Local Self Government and Housing Department", the words "Urban development and Housing Department" shall be substituted:- (b) for clauses (ii) (iii), (iv), (v) and (vi), the following clauses shall be substituted namely:- (ii) Secretary, Urban development and Housing Department. .....means separately identifiable investment made by an existing industrial unit in the fixed capital assets to set up a project for manufacturing of new products (s) provided that the additional investment in the fixed assets is not less than 25% of the gross fixed capital and increase of additional employment is at least by 10%. (ddd) "Expansion" of an industrial units means additional fixed unit. For the purpose of calculation, Gross value of all the capital investment made on land, building and plant machinery of the existing unit will be taken into consideration. Expansion shall also imply an increase of at least 25% in the existing installed capacity as well as increase of additional employment of at least by 10% . Prior to going for expansion, the units should be operating at least at a minimum of 80% capacity during the three previous years." THE SIKKIM MUNICIPALITIES ACT, 2007 THE SIKKIM MUNICIPALITIES ACT, 2007 (Act No. 5 of 2007) AN ACT To provide for the municipal governance in the State of Sikkim in conformity with the provisions of the Constitution of India as amended by the Constitution (Seventy-fourth Amendment) Act, 1992, based on the principles of participation in, and decentralization, autonomy, and accountability of, urban self-government at various levels, to improve the quality of life of the urban dwellers of Sikkim, to introduce reforms in financial management and accounting systems, to enhance internal resource generation capacity, to improve the organizational design of Municipalities, to ensure professionalization of the municipal personnel, and to provide for matters connected therewith or incidental thereto. THE SIKKIM STATE AUTHORITY FOR PLANNING & DEVELOPMENT ACT, 2007 THE SIKKIM STATE AUTHORITY FOR PLANNING & DEVELOPMENT ACT, 2007 Beit enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows :- CHAPTER I Preliminary Short title, extent and commencement 1 (1). This Act may be called the Sikkim State Authority for Planning and Development Act, 2007. (2) It extends to the whole of Sikkim except the cantonment areas. Explanation I " "cantonment area" means an area within the jurisdiction of a cantonment. Explanation II - "cantonment" has the same meaning as in the Cantonments Act, 1924. (3) It shall come into force on such date as the State Government may, by notification, appoint. 2 of 1924. Definitions. 2. In this Act, unless the context otherwise requires, - (1) "The Advisory Council" means the Advisory Council constituted under section 5; (2) "The Authority" means the Sikkim State Authority for Planning and Development, constituted under section 3; (3) "The Constitution" means the Constitution of India; (4) "The Empowered Executive Committee" means the Empowered Executive Committee constituted under section 4; (5).....

THE SIKKIM POLICE ACT, 2008 THE SIKKIM POLICE ACT , 2008 (Act No . 15 of 2008) AN ACT To make provision for the law relating to the establishment and management of the Police organization and its functions. Be it enacted by the Legislature of Sikkim in the Fifty-ninth Year of the Republic of India as follows: CHAPTER I Preliminary: Definitions and Interpretations Short title, extent and commencement 1. (1) This Act may be called the Sikkim Police Act, 2008. (2) It extends to the whole of Sikkim. .....The officer-in-charge of every police station shall maintain database in electronic form or otherwise, of all tenants and domestic or professional help living within the jurisdiction of the police station. Penalty 7. (1) Any house owner violating the provisions of section 3 of this Act shall, on conviction by a Magistrate of the first class having jurisdiction, be punishable with fine which may extend up to rupees five thousand in each case. (2) Any employer and/or manager of a household or establishment or land, vehicle, vessel or aircraft violating the provisions of section 4 of this Act shall, on conviction by a Magistrate of the first class having jurisdiction, be punishable with fine which may extend up to rupees five thousand in each case. (3) No magistrate shall take cognizance of an offence under this section except upon a complaint in writing made by the officer-in-charge of a police Power to make Rules 8.
