In section 9 of the principal Act,-- (a) for the words "The Chief Auditor shall include in his report a statement of --", the following shall be substituted, namely:,-- "The Director shall include in his report a statement of -- Part I-Serious Irregularities--"; (b) in clause (b), after the words "misconduct of any person" the words ", irregularity in awarding contracts, decisions causing revenue loss and financial losses caused by policy decisions" shall be added; (c) after clause (c), the following words and letters shall be inserted, namely:-- "Part II-Other Irregularities--".

In section 9 of the principal Act, in sub-section (3),-- (i) after clause (a) the following clause shall be inserted, namely:-- "(aa) the person who may be specified as dependent under sub-clause (g) of clause (ad) of section 2;"; (ii) after clause (cc), the following clause shall be inserted, namely:-- "(ccc) the transit accommodation and the period for which such accommodation may be provided under section 5A:"; (iii) after clause (ff), the following clause shall be inserted, namely:-- "(fff) provide for carry forward of unutilised free telephone calls pertaining to any year beginning on or after the 1st day of April, 2002 to any subsequent year;".

.....(d) shall be omitted; (iv) for clause (i), the following shall be substituted, namely:-- "(i) where the capital issued under clause (c) of sub-section (2B) of section 3 is -- (I) not more than sixteen per cent. of the total paid-up capital, one director; (II) more than sixteen per cent. but not more than thirty-two per cent. of the total paid-up capital, two directors; (III) more than thirty-two per cent. of the total paid-up capital, three directors, to be elected by the shareholders, other than the Central Government, from amongst themselves: Provided that on the assumption of charge after election of any such director under this clause, equal number of directors nominated under clause (h) shall retire in such manner as may be specified in the scheme: Provided further that in case the number of directors elected, on or before the commencement of the Banking Companies (Acquisition and Transfer of Undertakings) and Financial Institutions Laws (Amendment) Act, 2006, in a corresponding new bank exceed the number of directors specified in sub-clause (I) or sub-clause (II) or sub-clause (III), as the case may be, such excess number of directors elected before such.....

1[9A. Application of Sections 9-B, 9-C, etc. Notwithstanding anything contained in section 1-A, the provisions of sections 9-B and 9-C and the power to make rules in relation to any of the matters referred to in sections 9-B and 9-C shall apply only to such classes of Government securities created and issued by the Central Government, whether before or after the commencement2of the Public Debt (Amendment) Act, 1959, as that Government may, by notification3in the Official Gazette, specify, and in relation to such classes of securities the provisions of sections 7 and 9 shall have effect subject to the provisions contained in sections 9-B and 9-C. ________________________ 1. Sections 9-A, 9-B and 9-C were inserted by the Public Debt (Amendment) Act 1959 (44 of 1959), Section 2 (with effect from 1-8-1960). 2. That is 1st August, 1960. 3 . Provisions of Sections 9-B and 9-C have been applied to the securities created in the form of 10-Year Defence Deposit Certificates-

Title : Provisions of Sections 9 to 17 to Apply with Modifications to State Biodiversity Board

The provisions of sections 9 to 17 shall apply to a State Biodiversity Board and shall have effect subject to the following modifications, namely:-- (a) references to the Central Government shall be construed as references to the State Government; (b) references to the National Biodiversity Authority shall be construed as references to the State Biodiversity Board; (c) reference to the Consolidated Fund of India shall be construed as reference to the Consolidated Fund of the State.
